Do Elections Still Matter?

Election season is upon us.

Local and state elections are taking place and will continue through November 4th with the all-important mid-terms.  Do these elections really matter?  I would suggest perhaps more than ever.  These elections could determine if we ever have another election that even resembles fairness.  All have witnessed the effort to limit free speech and control the press in such a way as to affect the outcome of elections.  We have seen the term “voting intimidation” redefined so it applies for some but not for others based on the whims of the Attorney General.  We have seen efforts to enhance voter irregularities so as to benefit the 1016328_420444734736266_378341861_nMarxist/Progressives.  This election will determine the future control the Marxist/Progressives have to continue to further their agenda to complete the fundamental transformation to a classless Marxist society that was promised in November of 2008.  Not only are the congressional elections critical to stop this course of action, but so are all local and state elections. Many people will be assisting with campaigns, working phone banks and walking precincts.  We learned about private citizens being attacked by the directive of powerful people in Washington.  An example is Catherine Engelbrecht of “True the Vote” who has had the full power of the federal government attack her by a directive of Elijah Cummings.  Freedom Loving Americans advocate that only citizens should be allowed to vote and to prove citizenship is reasonable.  The Marxist/Progressives advocate that anybody should be able to vote including non-citizens, people who died, and pets.  They tell their supporters they should vote early and often.  We recently saw the Marxist/Progressives who advocate voting early and often believe so firmly in this concept that they honor those who admit to breaking the law with multiple votes.  North Carolina is learning many people have voted not only in North Carolina but also in different states. 10th Amendment Alive In Utah

Last week I wrote a little blog about HB 365. Thankfully PPJ was contacted by Conner who commented:

I am the state coordinator for the Utah Tenth Amendment Center and drafted this bill. It is currently under legislative review with Mr. Asplund. The text should hopefully be released this week.

We created the website http://www.utahintrastatecommerce.org to highlight the efforts around this and future bills of this nature.

According to the UTAC site, last year Utah took up Gun Rights as well:

In 2010, the Utah legislature passed, and the Governor signed, SB-11 (as did many other states). This law exempts firearms that are manufactured and sold within Utah from any federal regulation. A key paragraph reads:

A personal firearm, a firearm action or receiver, a firearm accessory, or ammunition that is manufactured commercially or privately in the state to be used or sold within the state is not subject to federal law or federal regulation, including registration, under the authority of congress to regulate interstate commerce.

Constitutional Sheriff Tony DeMeo

In this 3-part video interview with Tony DeMeo, Sheriff of Nye County, Nevada, he explains that he is a Constitutional Sheriff and that authority for public office holders is derived from the people. He tells the story about how he used the Constitution as his foundation in the saga of Nye County rancher Wayne Hage’s disputes over encroachments by the federal government. While Wayne Hage’s case centered around property rights in federally managed lands, Sheriff Tony DeMeo’s example is relevant for everyone to understand the power of local government, the importance of following the Constitution and upholding the Tenth Amendment (states’ rights and sovereignty).

Wayne Hage, the author of “Storm Over Rangelands, Private Rights in Federal Lands” owned the Pine Creek cattle ranch in Nye County. Wayne Hage wrote his book after suffering illegal cattle seizures by armed federal agents and chronicled the history of how the robber baron bankers and railroad magnates monopolized the western states over 100 years ago. Hage wrote that the northern core financiers were aware that there are two ways to monopolize any resource, “One, get all of it for yourself that you can; two, keep anybody else from getting what you can’t.” Public Lands and National Forests were created along with restrictive regulations, using environmental protection as the excuse.  More

A Declaration of Individual Sovereignty

Given all the talk, lately, of the decalaration of sovereignty by several states, I have noted that there is little corresponding talk of individual sovereignty.

This is not at all a new concept and has a long history, at least as a philosophical ideal. I recall members of the Libertarian movement (not necessarily the Libertarian Party, who chose to allegedly achieve their ends by becoming part of the state they sought to supposedly do away with), back in the seventies, talking about individual sovereignty and individualist anarchism, etc, and these concepts were promoted in the nineteenth century by such individualist anarchists as Lysander Spooner.

Now, many may consider this far too radical an idea. Many will consider it preposterous, in fact. But, consider that those who do so have spent their entire lives with their minds entrained by a false society based upon the unseen rule of an all-encompassing unelected oligarchy – the very people we should all be rebelling against at this moment.

Given that our government, both federal and state, derives it powers to govern from the consent and will of the people, does it not follow that the same provisions of the Tenth Amendment that are currently being used by the states to declare their sovereignty may also be used by the people? In fact, the Tenth Amendment says so:

“The powers not delegated to the United States by the Constitution nor  prohibited by it to the States, are reserved to the States respectively, or to the people.”

What this means is that whatever rights that aren’t specifically mentioned as powers of either the federal or state governments exclusively are also granted to the people. So, if a state can declare its independence of the federal government under the Tenth Amendment, then so can an individual declare himself/herself independent of both the federal or the state governments in the event that both become despotic.

Now, it is my preference to have some form of minimal government. After all, the Declaration of Independence says:

“…Governments are instituted among Men, deriving their just powers from the consent of the governed…”

The historical precedent is that humanity has relied, in one form or another, on some degree of governance, however imperfect that may be. But, what if all attempts (and, should the states succeed in shrugging off the current regime, this would be at least our third attempt to get it right, the first being the Articles of Confederation, the second being Federalism and the third being whatever comes next) to arrive at a just government continue to fail? What if the states withdraw from and dissolve the federal government, only to become equally as tyrannical, themselves? Then we have not one despotic regime to deal with, but fifty of them.

In looking ahead to what might happen, I see this as a very real possibility, granted that we know our states are currently infiltrated by those who serve the interests of the current federal government and the unseen oligarchy controlling it, and not the interests of the states or the people. In such a situation, can we realistically expect that the states, once freed of federal rule, won’t also become tyrannical regimes, themselves? It seems rather unlikely to me, given the lessons of history.

Therefore, as a sort of “insurance policy” of sorts, I’ve written – for whatever it may be worth (and I acknowledge that may be very little or nothing, given the present situation), a Declaration of Individual Sovereignty. Take it as you wish, do with it what you will, and feel free to re-write or revise it to suit your own needs or goals. I’m keeping my own copy – just in case.

A Declaration of Individual Sovereignty

Be it known that I, _______________________, the undersigned, do hereby declare myself to be a sovereign individual under the provisions of the Tenth Amendment to the Constitution of the United States of America and that I reserve for myself all the rights and powers conferred upon the People of the United States of America by the Tenth Amendment to the Constitution of the United States of America, which states:

“The powers not delegated to the United States by the Constitution,

nor prohibited by it to the States, are reserved to the States respectively,

or to the people.”

Recognizing that both the Federal Government of the United States of America and the governments of the several States derive their just powers to govern from the consent and will of the People, and that the People may reserve the right to throw off the bonds of servitude and oppression of a tyrannical government, as per the guarantees made in the Constitution of the United States of America and the Bill of Rights, it is the incumbent duty of all the People to declare such tyrannical governments null and void according to the provisions and limitations imposed upon those governments by the Constitution of the United States of America and to either seek to establish a new and just government in adherence to the Constitution of the United States of America or, if that has become no longer possible, to declare themselves, each one, an individual sovereign entity beholden to no governance save for their own.

In accordance with these aims and purposes as stated herein, I hereby and herewith declare myself to be free of any and all governance by either the Federal Government or any of the several States of the United States of America and I hereby and herewith reserve and reclaim all the rights enumerated by the Constitution of the United States of America and the Bill of Rights, as well as all natural rights not enumerated by the Constitution or the Bill of Rights, such as they are recognized to be inherent conditions of human existence. These rights shall include, but are in no way limited to the rights to life, liberty and the pursuit of happiness, as well as the right to keep and bear arms, which shall be construed to mean any and all types of weaponry that may be necessary, in defense of my life, liberty and property from all aggressors whoever they may be.

Federal usurpation goes beyond anything the Constitution’s framers would have imagined. James Madison, explaining the constitution, in Federalist Paper 45, said, “The powers delegated … to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, [such] as war, peace, negotiation, and foreign commerce. … The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people.” Thomas Jefferson emphasized that the states are not “subordinate” to the national government, but rather the two are “coordinate departments of one simple and integral whole. … The one is the domestic, the other the foreign branch of the same government.”  [. . . ]One of the more disgusting sights for me to is to watch a president, congressman or federal judge take an oath to uphold and defend the United States Constitution, when in reality they either hold constitutional principles in contempt or they are ignorant of those principles.
 
State efforts, such as Oklahoma’s, create a glimmer of hope that one day Americans and their elected representatives will realize that the federal government is the creation of the states. A bit of rebellion by officials in other states will speed that process along
