The Patriot Act, the law used to justify mass government surveillance, is going to expire if it’s not reauthorized this week.

If Congress fumbles for the next few days, the Patriot Act will not be renewed — and right now, the vote is close enough that a big push by people like you and me can tip the scales and ensure the Patriot Act expires, dealing a death blow to unconstitutional NSA programs.

We’re joining with half a dozen other organizations including Demand Progress, Restore the Fourth, CREDO, MoveOn.org, and Free Press Action Fund to host 50 “EMERGENCY vigils to Sunset the Patriot Act” across the country tomorrow night, calling on senators to vote against reauthorization.

Here are the details:

WHAT: Emergency “Sunset the Patriot Act” vigils against mass surveillance – happening in 50 cities across the U.S. WHEN: 7 pm local time, Thursday, May 21st (roughly an hour before sunset) WHERE: Find your local event here. If you don’t see one and want to set one up outside another of your senators’ offices, reply to this email and let us know! BRING: A cell phone, laptop, tablet, and candles with the protestsign.org already pre-loaded. Feel free to bring any other signage you want — the main message is “Sunset the Patriot Act”.

News reports show that the Senate is all confused so they’re going with the plan of ramming through the bills. That’s because we have filibuster threats from at least two senators — Rand Paul and Ron Wyden — a looming expiration date, and confusion about the best course of business. And, if we have voices from all over the country calling on them to end the Patriot Act, we can make them falter and split and fall all over themselves. This is the time when doing nothing actually helps us.

That’s why action right now is critical — according to our whip count, dozens of senators are still on the fence, and protests across the country the day before the vote can prevent them from throwing their support behind the Patriot Act. If we can prevent these last senators from siding with the NSA, the Patriot Act will expire.

After all these years of fighting against how the Patriot Act has torn up our freedoms without making us any safer, it all comes down to the next couple of days. This is our week to end the Patriot Act.

Legal v Lawful:  Weasel word swapping at its finest

Weasel word swaps are those words and phrases that sound as if they mean a certain thing and, most of you have been conditioned to believe mean something specific, when in fact, they do not. The recent ruling by U.S. District Judge William Pauley III who took it upon himself to violate the Constitutional rights of every American citizen when he decided that the unwarranted and illegal  NSA spying on virtually everyone, was LEGAL (he did NOT say lawful).  The swapping of the word legal as opposed to lawful requires a closer look.

Definition of legalize:

To make legal or lawful; to confirm or validate what was before void or unlawful; to add the sanction and authority of law to that which before was without or against law.  

In other words, the NSA Spying without probable cause, without obtaining a warrant  is and was1441183_401318466665654_1752838926_n unconstitutional and therefore, unlawful.  Pauley, who knew exactly what he was doing, attempted to by-pass the Constitutional prohibitions against exactly this kind of unfettered and lawless activity by the government and its incorporated agencies to make an otherwise Constitutionally prohibited activity appear to be lawful.

Conforming to the law; according to the law; countenanced by the law; good and effectual in law. Not forbidden or discountenanced by law; good and effectual in law.

This contrasts with a ruling earlier this month by U.S. District Court Judge Richard Leon who ruled that the spying was in fact, unconstitutional and unlawful.

The recent pattern of federal government abuse is very troubling, undermines citizens’ trust in their government and we, the American people, deserve an explanation from this government as to why this administration and others including Congress used its vast powers to commit these unconstitutional acts.

Congress wrote and passed the Patriot Act and the National Defense Authorization Act (NDAA) and 8907_416984598415613_2032451742_nwas signed into law by Presidents Bush and Obama respectively. According to U.S. Rep. Tim Walberg, who is a member of the House Oversight and Government Reform Committee which has been investigating IRS-related issues said “The lack of preparedness in rescuing Americans under attack, and the administration’s misdirection to investigators seeking the truth about the deaths of four Americans in Benghazi is disgraceful. Driving up to the pumps, I have a distinct experience of entering  “No Man’s Land.” Gas is up over three bucks in Oregon and shows no sign of ever coming down. It strikes me that this feels like an affront, a virtual assault —that the price of gas is actually attacking my ever-diminishing financial reserves, and laying waste that green stuff which constitutes my nest egg. 

A confluence of forces are amassing at this point in time, which are keeping folks home much more than in past years. One is the price of gas. Another is the plunge of the dollar, world-wide. My intended trip to Jerusalem and points beyond will be deferred to a later date, for this reason alone. 

Other economic realities buttress the decision to stick around home plate. Job insecurity coupled with the spectre of possible home foreclosure amp up the sense of financial anxiety. The net effect of these  conditions  is that Americans are more home-bound. Like so many other Americans, I look anxiously to the political horizon to see a sign of change but see only a changing of the guard as our collective economic future marches towards a dark terminus.   More

The Department of Homeland Security’s network of fusion centers operate under the auspices of state police or even large local police forces, thus sidestepping the guidelines enacted under the Privacy Act of 1974 that limit information sharing by federal agencies. Yet fusion centers have a national command center feel, with mosaics of television monitors, and desks for all the police agents assigned to work together and enjoy face time — the county sheriff, local police officers, the FBI, National Guard (restricted by law to drug-related missions), state police, Department of Homeland Security, and the civilian intelligence analysts. The FBI field office may rent space to fusion centers, and even helps run the Los Angeles fusion center, but it rarely plays a visibly lead role. THE QUESTION

There has been a whirlwind of legislation in America over the past ten years; statutes which both add to and convolute our already oppressive society.  So, I figured a little insight into living under these laws might be timely.  There are so many, so I’ll just address what I think are the most pointed.

At what point we will say “enough!”?  H.R 1955 and the companion S. 1959, both known as the,

 Violent Radicalization and Homegrown Terrorism Prevention Act of 2007

 

are both nothing more than an outright assault on our civil liberties disguised as anti-terrorism prevention.  These bills are no different than the horrendous Patriot Act or the Security Enhancement Act of 2003.  The words terrorism, terrorist(s) are used only when our constitutional rights are being attacked, and then only as means of justifying the further erosion of our rights and the empowerment and expansion of the government and military over our daily lives.

 

Congress and the president are constitutionally prohibited from abridging our freedoms enumerated in the Constitution.  Why do we tolerate these overt acts of suppression and terrorism by those in our government who have become so fearful of the general population and what could be the reason for this fear?

 

We had the recent opportunity to vote all these bums out of office.  Why were so many of us so willing to re-elect those who have shown us they despise us?

This note was part of an email from the Canadian Action Party, in response to a question posed to them.  Americans should take note of this also.  As we have advised you in the past, google, gmail, facebook, myspace and other sites of this nature, routinely data mine all of your info and sell it to any of the 15 spy agencies working for the federal government, including Homeland Security.  We thought you might find this email interesting.

The commissioner has ruled amongst other things that facebook has violated our Canadian laws. You should be able to google that judgement.

 

The Patriot Act gives the US Government access to any data stored on servers in the US if they so desire. There is no requirement to reveal to individuals that their data has been accessed. When the Government of BC decided to out source the medical records of British Colombians to a US firm there was a brief bruhaha  which quickly was relegated to the back pages. Reality is, if you are HIV + or have Hep C there is absolutely no guarantee that the US can not access your records and use them against you.

 

In fact the servers don’t have to be in the US, if the company operating them is US owned they must divulge info on request, again without even reporting the access/breach.

 

In Canada if the security of your private info is breached the company or organization that is breached must divulge. I have been advised by both CIBC Visa and Credential Direct (Brokers) when my private info was breached. They provided syrupy “we’re sorry” letters.

 

IT trade journals routinely report the risks to Canadians.

 

If you wish specific examples and have no luck with the Privacy Commissioner’s site let me know and I will email examples. I routinely hand the references out to my students advising them that they should be fully aware of the risks of using facebook, myspace, and especially gmail and google applications.

State of the Union: The Bush Treason

Last week, President Bush gave Congress his last State of the Union speech. Proving that the presidency erodes a man–he looked worn, haggard, colorless and beaten. His words rang vacant, hollow and scratched like fingernails across the chalkboard of Americans’ sense of honesty.

In truth, he looked every bit the part of a new book: “The Bush Tragedy” by Jacob Weisberg. Newsweek reported, “As Bush’s presidency nears its end, prospects for the Republicans look bleak…GOP candidates running in the wake of his wreckage can learn much from his failures…he squandered the peoples’ trust.”

On January 20, 2001, he raised his right hand and placed his left hand on the Holy Bible, “I do solemnly swear that I will faithfully execute the Office of the President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.” (Article 2, section 1) He repeated the same ceremony for a second time.

Concerning the basics of our U.S. Constitution: he lied to us, he violated his oath of office and created a boondoggle of a legacy as he mounted $3 trillion onto our national debt. He oversaw the loss of millions of jobs, accelerating trade deficits and foisted a complete fraud on us as to national security from terrorism with his failure to secure our borders.

What about how he affected American families? What did he do to us on a personal level? What didn’t he do to preserve, protect and enhance our lives?

I’ll tell you how! Last week, in Denver, Colorado, 21 year old U.S. Army soldier Duncan Crookston died after five months of misery. He suffered both legs blown off, his right arm amputated and his left hand cut from his body. He suffered horrific burns. His young wife sat by his bedside for five months only to see Crookston’s life slip away.

That same sickening scenario repeated itself 3,900 times in the past six years since George Bush declared an unlawful war against a sovereign nation–after he strutted across an aircraft carrier with a banner that read, “Mission Accomplished!” It means 3,900 family members trusted Bush to carry out his oath of office, but instead, he deceived them and us–into a vain war. He maintains his corrupt war with no plan for withdrawal—only more death and chaos.

One mother said, “Why is Bush preparing for his daughter’s wedding while I plan for my son’s funeral?”

While he prolongs his personal war in Iraq, he protects the Korean border with 35,000 U.S. troops while allowing millions of illegal aliens and uncounted terrorists full access across our southern borders for the past seven years. Any president with a brain larger than a prairie dog’s would have sealed our southern borders on 9/12/01 as the oath of office demands.

While he kills or maims our kids in Iraq, thousands of our citizens suffered death from illegal aliens who drive drunk, murder, rape, rob and distribute drugs. All of those nightmares would have been prevented if he had followed through on his oath of office by securing our borders. (Article IV, Section 4)

The other results of his Iraq War? He poured $600 billion and up to $1 trillion down a rat hole in Iraq and Afghanistan that hasn’t improved those countries one iota—and hasn’t caught Bin Laden or made this country safer. He killed hundreds of thousands of civilians. He inflamed the rest of the world against us. Over 75 percent of the troops from other countries pulled out. He’s maimed and amputated 29,000 of our finest kids who trusted his felonious judgment. Every year U.S. Army military suicides rise with 2007 topping at 121 kids. Dr. William Polk, author of “Violent Politics” told Congress last week, “More than 500,000 of our troops will need a lifetime of mental health care following their multiple deployments in Iraq.”

Bush spent 30 minutes insisting on how much progress we’re making in Iraq. Any drunken fool at a bar would lament, “What a crock of horse manure!”

Instead of taking care of the economic business of our nation, he watched annual trade deficits grow to $700 billion. He forced our country to borrow $2 billion daily to float our vacuous economy. Bush watched 10 million more illegal aliens cross our borders while he said, “They come to do the jobs that Americans won’t do.” Migrants do those jobs at slave wages, but they enjoy anchor babies at our expense, free breakfasts and lunches in our schools on our tax dollar and 400,000 convicted felon illegals enjoy free room and board in our prisons. Meanwhile our middle class sank into a new ‘poor class’ here in America.

The facts show that those migrants, now 20 million strong, degraded our culture through lack of assimilation, and now, because of Bush’s non-enforcement policies, we must tolerate, “Press 1 for Spanish or 2 for English.” We must tolerate millions of illegals marching in our streets demanding rights they do not possess in our country, which they unlawfully entered.

In Michigan last week, Governor Jennifer Granholm begged companies and corporations to move to Michigan where she promised no taxes. Her pleas resulted from Bush ignoring 3.1 million manufacturing and IT jobs leaving our country through insourcing, offshoring and outsourcing for the past seven years.

Fallout while Bush languished in the presidency: 1. Greatest foreclosure fraud on housing in American history. 2. No national energy conservation policy. 3. No movement toward solving climate change. 4. No immigration policy that leads to a stable U.S. population. 5. Nothing advanced to employ 14 million unemployed Americans. 6. Horrific $9 trillion debt. 7. $3.50 a gallon gas. 8. Social Security, Medicaid and Medicare bankrupting. 8. War on Drugs a total and complete failure and waste of $560,000 billion during his watch. 9. Worked to dissolve America’s borders by signing the Security, Prosperity Partnership that will destroy our sovereignty and force us into the North American Union with Canada and Mexico. 10. Patriot Act took away individual liberty.

George Bush’s legacy stems from his lack of integrity. Our predicament stems from his violation of his oath of office. This country may not survive the aforementioned items not mentioned in his State of the Union address. He proves himself the most inept, incompetent and disastrous president since the inception of this Republic.

Are we appalled enough? Are we incited enough to step up to the plate in the coming months by insisting on a president who values and upholds the sacred Constitution of the United States of America?
