Colorado’s Supreme Court has used its power to help itself – again. This time, it’s to wipe out an embarrassing 97% dismissal rate of complaints against judges.

By rewriting the rules for Colorado’s Commission on Judicial Discipline, the Supreme Court stops the incredulous 97% dismissal rate from continuing. The rate hit 97% in 1993 and has been 97% ever since – 24 years. But the Supreme Court has ensured the rate won’t continue.

How? By redefining “complaint.”

Under the new rules, a complaint will no longer be a complaint when a person files a complaint with the commission. A complaint will only be a “complaint” when the commission finds there are grounds to proceed. Before that point, what has been a complaint will now be called a “request for investigation.”

Requests for investigation won’t be dismissed. Those files will merely be closed if the commission finds there aren’t grounds to proceed. The 97% dismissal rate disappears into those closed files. Clever, huh?

So instead of spending valuable time hearing more cases that should be heard at the Supreme Court, or encouraging vigorous enforcement of the Code of Judicial Conduct, our justices spent time figuring out a crafty plan to cover their tracks.

Obama’s Reckless Refugee Program Mirrors his Ebola Policy

Preview:  Like the response to Ebola, this is another instance where Mr. Obama is acting in flagrant disregard for the safety of Americans and the homeland. And let us not forget that his precipitous withdrawal from Iraq, betraying the sacrifice of thousands of our best and bravest, led directly to the rise of ISIS. Let us also not forget his utter disregard for border security and for federal immigration law.

We cannot wait for an election still a year away, the outcome of which is obviously uncertain. There is an overwhelming case for immediate impeachment of the enemy in the Oval Office. The safety and survival of the Republic is in jeopardy.

Our feckless president’s reckless push to bring “refugees” from Syria, who are 97% Muslim and mostly men of fighting age, into the United States is analogous to his open border policy regarding potential Ebola carriers.

A little over a year ago, an Ebola-infected African immigrant was admitted to a hospital in Dallas with full blown Ebola. His stay at that hospital transformed it to the front line in a crucial battle. Two nurses who treated this man became infected. Miraculously, both survived and the disease didn’t spread further (though one of the nurses traveled in a jet with a fever, after being cleared by the CDC!).

Shortly thereafter, a young doctor, just back from treating Ebola patients in Africa, traveled around New York City with early symptoms of Ebola before being transported and isolated at Bellevue Hospital. Again, miraculously, no one else was infected by this individual.

I wrote in an op-Ed in November of last year, “There is simply no dispute that Ebola needs to be contained in West Africa. This clearly means limiting travel from this region to the United States, and requiring adequate quarantines when U.S. citizens return. Nigeria has done this and has successfully contained their outbreak. Australia became the first of the so-called developed nations to impose a travel ban…. Instead of travel restrictions, foreign health workers afflicted by Ebola may be airlifted into the U.S. for treatment. This is the opposite of containment.”

The Obama policy placed Americans at risk. Even one death from Ebola brought in from Africa would be one too many. The infected nurses were fortunate to survive, and went through an ordeal. A handful of infected people arriving in a city such as New York would place an enormous burden on the health system, and would have the potential to create a serious outbreak with many infections and deaths. This nightmare scenario did not materialize because Brussels Airlines, which has nearly complete control over flights from Ebola endemic regions, instituted an effective screening program. More

While I tried to stay out of the fray on the “birther” issue……Here is Obama himself saying that he is not a US born citizen…..and that it should make no difference.  That’s all she wrote folks!  Get him out of there!  Marti

cards_bigThere is much to celebrate, as there is only 33 days until George W. Bush leaves the White House.  In addition, Congressman Nadler, Chairman of the Subcommittee on the Constitution, recently introduced a resolution expressing staunch opposition to any potential preemptive pardons of members of his Administration and the need for an Independent commission or select committee to “investigate, and, where appropriate, prosecute illegal acts by senior officials of the administration of President George W. Bush.”

I fully support this resolution and I have signed on as a co-sponsor.

The issue of preemptive and/or blanket pardons has been a subject of much debate and frustration. There is great concern that Bush will abuse his pardon power and further cover up wrongdoing by his Administration. 

However, as citizens, we have a responsibility to reject any abuse of the presidential pardon power to shield or manipulate investigations.

Regardless of the legality of potential pardons, there needs to be a full accounting of this Administration’s abuses.  No doubt many of the players in the Administration will seek future positions or public office.  The public deserves a full accounting of what they have done, and the law, in my opinion, requires it.

Many felt that President-elect Obama’s victory might free members of Congress to move forward with Impeachment Hearings.  However, the weeks since the election have been largely consumed with trying to formulate a balanced and thoughtful response to the economic crisis, which, no doubt, is affecting many of you.

The struggles of the American auto industry, and the ongoing banking and credit crisis, skyrocketing unemployment, and our exploding budget deficit have taken center stage. 

Some of our most critical issues – universal healthcare, Medicare and social security funding, alternative energy investment, and education improvements are all threatened by this crisis.  Although I am committed as ever to holding this Administration accountable, we are facing a historic crisis in this nation that Congress and President-elect Obama must work together to solve.

Obama’s victory gives us a window to accomplish vital tasks that will have very direct impact on you and your family. 

I thoroughly believe that President-elect Obama will return us to a government that respects the rights of its citizens and the rule of law.  I look forward to working closely with his Administration to not only repair the damage, but bring forth a renewed sense that government is, in fact, responsible and answerable to the people.

“Nothing. It would end up in courts but the action would have been taken.”

“Nothing. He could do what he did in Iraq — send a tank down a street in Washington and fire a shell into the Washington Post as they did into Al Jazeera, and claim they were firing at something else.”

“Given the danger do you advocate impeachment?”

“Yes. President Bush struck down Posse Comitatus — which has prevented, with a penalty of two years in prison, U.S. leaders since after the Civil War from sending military forces into our streets — with a ‘signing statement.’ He should be impeached immediately in a bipartisan process to prevent the use of military forces and mercenary forces against U.S. citizens”
