All Decisions by Acting Park Service, BLM, and Fish & Wildlife Heads Legally Void


Washington, DC — President Trump’s record tardiness in nominating agency leaders may undo months of work inside the Department of Interior, according to a complaint filed today by Public Employees for Environmental Responsibility (PEER). The way the Trump administration has filled agency leadership slots with temporary or acting directors violates a law enacted to prevent a president from circumventing the U.S. Senate’s constitutional advice and consent power.

The PEER complaint filed with Interior’s Office of Inspector General charges that the acting directors of the National Park Service (NPS), Bureau of Land Management (BLM), and U.S. Fish & Wildlife Service (FWS) are in blatant violation of the Federal Vacancies Reform Act. Under that act, any action taken by a noncompliant official “shall have no force or effect” nor may it be later “ratified.”

“The law prevents a president from installing acting directors for long periods and completely bypassing Senate confirmation,” argued PEER Executive Director Jeff Ruch, noting that President Trump has not nominated or even announced an intention to nominate, persons to fil the NPS, BLM, or FWS vacancies.
“Federal agencies are not supposed to be run like a temp service.”

The complaint recounts Vacancies Reform Act violations invalidating the appointments of –

  • NPS Acting Director P. Daniel Smith, who did not serve in a senior position for 90 days during the prior year, as the Act requires. Nor did Trump appoint him, another requirement of the act;
  • BLM Acting Director Brian Steed, who also did not serve in a senior position for 90 days and Interior Secretary Zinke, not Trump, appointed him.
  • FWS Acting Director Greg Sheehan, who not only suffers from these same deficiencies but also now exceeds the 210-day limit the act imposes.

National Blueways System: Federal water theft “headwaters to mouth”

National Blueways System

The provision within the National Blueways system for “headwaters to mouth” is the new catch phrase for “waters of America”.  Using the tried and true method of renaming an assault on the states to make it sound like a good deal when we know it isn’t, is nothing new.  The intent is to take over all water from any source whatsoever.

While the government is planning on blowing out more than 2600 dams here in the US, allowing fresh legal vwater resources and reservoirs to flow away into the ocean, we are constantly warned of a water shortage.  The excuses for this is that rivers need to be restored to their former states to save some fish that has long ago adjusted to its surroundings.

Since there is in actuality no critical water shortage, one has to be created.  This will be done by redefining what is federally controlled water, and, by emptying reservoirs and other water reserves.  No dams will replace those blown meaning that all water in that river or stream will disappear into oblivion while your water is rationed.  All of this just in time for the installation of SMART Water Meters which will drive your water bill through the roof.

But the issue of water is not about the salmon, or the rivers flowing free or any other environmental nonsense.  It is converting all water everywhere to be under the control of the federal corporation to facilitate the LOST treaty, and to convert even simple trade into federal commerce.

The National Blueways Water System appears to be the work of the infamous Ken Salazar, Secretary of the Department of interior, but is actually the intended result of several executive orders from the president. Secretary Sally, as he is often referred to, has been the facilitator of the massive land devastation in the Western States.  His plans to “industrialize” the western states have resulted in the decimation of our wild horses and burros, for reasons unknown, the selling off of public lands to private corporations,  and of course the whole sale destruction of water and land resources which are in reality, state assets.  The Department of Interior, as a privately owned federal corporation, rakes in the profits from this whole-sale plundering of state lands and resources while supplying minimal compensation to county’s and states governments.  Of  course the state is left with the now devastated landscape and pools of irreclaimable contaminated water. Our biggest waste of money is Congress

Several of you have written me and said things to the effect that if I am so damn smart why don’t I tell you all how I would fix the national debt and reduce spending in the District of Criminals.  So, as my New Year’s gift to all of you, here is my idea of how to rid ourselves of massive amounts of national debt and reduce theinfo 2 mindless, pork laden spending done at our expense. It is not a full and complete list as this would require so much space and days of reading, that I am only highlighting three or four of the most wasteful, unconstitutional, pointless agency’s or programs.

And, no I do not think I am so smart.  I do however, think that I am highly pissed off that we allow this crap to continue.

How the Fed gets in your state

The one thing that must be understood is that the only way federal corporations who try to hide their true identity by masquerading as “Public service” or some other clever word exchange, gain access to your state is only by getting approval from your governor and directed to the corresponding agency within the state that will contract with them.  These are not laws as per the Constitution.  This is contract law and the ensuing contracting with the federal corporation attempting to gain entry into your state is a corporate business plan which has little to nothing to do with law or property rights.  These are contracts that can be revoked, and, these are business plans that should be rejected across the board.

The first order of business:

1.  I would close down and completely disassemble Homeland Security.  This monolithic monstrosity has nothing to do with national security, keeping you safe or any of the other idiotic jingoistic crap that issues from them on a daily basis.  The Economist published a wonderfully explicit graph  in September of 2011 showing the cash sink hole that is Homeland Security.  More

Investor State Tribunals: The Trans-Atlantic Partnership AGREEMENT

A huge collection of federal corporate agents that we call “senators” and “representatives” will soon be jumping in front of Lame Street Media camera’s just for the chance to tell you how this new agreement will create thousands of new jobs.  And it will!  Only not here in the US.  These same corporate puppets will poo-poo the idea that this corporate government agreement will render our laws null and void against marauding corporations.  They will tell you that it will boost states economies to have foreign investors buying land and exploiting resources.  They will tell you any lie they think will make this sell off of our country more palatable.  And, by the time most of you figure out you just got sold out and sold off, these same liars will have taken retirement so that they can spend more time with their families.  (Oh! be still my heart!)

What this agreement will effectively accomplish is the eradication of national jurisdiction, national laws and protections and put disputes in the hands of lawyers who also expect to profit from their misdeeds.  It will sell off our land to foreign corporations and governments and firmly establish sovereign foreign territories inside the geographical US. akin to the current Free Trade Zones (257 zones) now operating across the states.

How’s that global economy working for ya? More

This EA states BLM is proposing to remove an “excess” 53-86 burros and leave only 70 burros on a 151,782 acre Herd Management Area (which is PRIMARILY for use by the wild horses and burros).  More

In the YouTube video, the balding (like me) gentleman at the right-corner of the table is Gary Cadd who was on the National Marine Fisheries Service-dominated North Pacific Fishery Management Council that meets in Alaska.  He is a goldmine of information on the corruption of bycatch of coho and Chinook salmon in the Gulf of Alaska affecting our fish populations in California and Oregon. 

He spoke with many “observers” on the airplane in trips he took to Council meetings between Anchorage and Seattle, and learned first-hand that the NMFS-employed lay-public observers are kept below deck on ocean trawlers so the bycatch (coho and Chinook salmon) are pitched overboard before the observers are allowed above deck to see the fish being retrieved out of the trawl nets–the Chinook contain coded wire tags needed to document the origin of the fish (see below) and the coho have marks allowing them to be associated with their hatchery origin. 

Fishing would have to stop if the excessive bycatch limits were observed on deck. The observers during debriefing, before being swept back to Seattle, are discouraged in their reporting of illegal activity of Chinook and coho salmon bycatch–I have a friend and former student who has personally experienced this corruption in debriefing by NMFS or other government agents. We know from history that when a country loses its ability to feed its own population, its demise is soon to follow.  As a nation we are being systematically, incrementally and intentionally driven to the point where we cannot feed our own people.  The quickest way to collapse the economic viability of a nation is to destroy its agricultural sector.  It isn’t gold or silver, global investments and markets, or multi-national corporations and illegal agreements that sustain economies.  What does sustain and support a vibrant economy is a strong independent agricultural sector.   

The underlying backbone to every economic model is agriculture.  And that model is not predicated upon anything other than local, hands on, food production in all its forms.  Key to undermining and destroying that model is the intentional destruction of the right to engage in agricultural activity using arbitrary regulations, laws, rules and agency police state enforcement actions perpetrated against independent and/or family owned agricultural operations.  Creating barriers to entry into agriculture is key to collapsing an independent agricultural sector which is what got us the fake food safety bill passed by “Dirty Harry” Reid, and his merry band of corporate hiney-hugging, US senators. 

While these operations may be small financially, in comparison to big Ag industrialized activities, the independent sector comprises the bulk of our food supply.  It is this supply that our own government is determined to eradicate in favor of global corporate stakeholders.

People have noticed the 25 government agencies on Obama’s new White House Rural Council.  And, they’re questioning what might be the need for all of them.

What people may not have noticed yet, is that the government agencies in this council are also on other councils.  These councils, as well as the individual government agencies, are implementing international laws that have taken effect through Executive Orders, Memorandums of Understanding, agreements and regulations that most Americans don’t even know about.  These have bypassed Congress.  And, it also seems they have completely bypassed the Constitution.

The devil is in the details

These agencies and councils are forming “partnerships” with members and groups other than the American people.  However, our tax dollars pay for their salaries and for the programs.

Some “partnerships” sound innocuous, but as you might guess, the devil is in the details.

I’ll give you an example.  There is a BioEco Working Group ( www.bioeco.gov), which at first glance seems to be part of the Department of Interior’s U.S.Geological Survey, since it is listed as creating the website.  But the actual Charter has National Science and Technology Council in the heading.  (The National Science and Technology Council includes 20 of the same agencies that are on the new Rural Council, but with some additional agencies, including the CIA.  It also includes the Vice-President, Cabinet Secretaries, heads of Agencies and some White House officials.)  More

The Bureau of Land Management (BLM), a for-profit federal corporation, issued a memo laying out its plans to seize 10 million additional acres across the Western states including, Nevada, Oregon, Wyoming, California, and Utah.  The federal government already claims ownership or control of 84% of Utah and at least 68% of Nevada. The document clearly lays out the propaganda to be used in this land theft, referring to the theft as saving national treasures, pristine areas, treasured landscapes, etc.. Sounds really peachy until you get to the part about mining and natural resources, to be stolen at the same time.

Concealing their identity under the appearance of a “public agency”, BLM uses congress and the executive branch to not only hide what it really is and what it is doing, but to make it appear legitimate; lawful, legal.  It is a deception that has gone on since 1906 when the Antiquities Act was passed, which BLM now is claiming as its enabling legislation.   The 1906 Act was only 296 words long and said nothing about how to perpetrate theft of states lands and their accompanying natural resources. 

The question immediately arises in my mind; “How can the BLM claim ownership of land? Doesn’t the Constitution expressly deny the central government ownership of any land other than insular possessions, territories and the ten square mile parcel of land ceded to it for its existence?” Yes it does, but the Bureau of Land Management is a privately owned corporation and is not bound by constitutional restraints.   More

Bloody Ken Salizar (Sally), head of the Department of the Interior and his goon squad, The Bureau of Land Management (BLM) are now considering expanding their slaughter of wild and protected animals, in the Western States.  Apparently, slaughtering America’s wild horse herds isn’t enough. In conjunction with the USDA, another of those privately owned federal corporations that works against the public while telling us that their assaults on agriculture is good for us, Secretary “Sally” is contemplating butchering 400 wild bison that have ventured out of Yellowstone Park in search of food due to the harsh winter. The USDA is eager to help; supplying all the false science they can conceivably come up with to justify killing off another irreplaceable herd of wild animals.  More

During a Grass Roots Horse research project looking into the FY2011 Budget for the Department of Interior which oversees the Bureau of Land Management, the agency entrusted with the management and protection of America’s wild horses and burros, it was discovered that the Interior has received 445.4 million dollars which is an increase of 106 million dollars for federal land acquisition through the Land and Water Conservation Fund. Another assault on the American public is under way; this one will enlarge and increase the power of the Department of the Interior and the Bureau of Land Management to such a degree that none of us will be safe from these corrupted and unlawful corporate federal agencies operating under the public deception; “a public service agency”. These are in fact, duly authorized and chartered private corporations which have long since ceased to function as public services, if in fact they ever did.

Those who ramble through the halls of the District of Criminals, who claim they have no time to write the bills; no time to read the bills, somehow found the time to vote to pass this federal, land, asset and natural resource grab, including water rights, through the House.  The bill now rests in the Senate, where there is little chance that the property rights of individuals or states, will survive. 

HR.3534, Consolidated Land, Energy, and Aquatic Resources Act of 2010 (Reported in House – RH)  will effectively render a greater amount of land as owned and/or controlled for profit, by the federal government along with minerals and water rights to now be controlled by the federal government and enforced through the BLM and other newly created enforcement agencies. A big Stinkfly award goes to Ken Salazar!

Ken Salazar, quite possibly one of the most insidious characters to occupy an appointed federal office since maybe, Donald Rumsfeld, has just topped his own high measure of malfeasance.  Heading up what has become notorious for being one of the most grossly mismanaged agencies of the federal government, the Department of the Interior (DoI), Salazar has set into motion some of the worst plans and policies ever implemented by the DoI.  Among these policies is the eradication and zeroing out of herds of wild horses and burros all supposedly protected under the 1976 Wild Horse & Burro act. 

Its unfortunate that the 1971 Act contained no provisions allowing for the protection of the herds from the BLM, itself.  The BLM represents the most formidable threat not only to the wild herds, but also to the environment and biodiversity as well.  More

Adding further to Dan Haley’s editorial on Ken Salazar: The energy interests are not the only ones receiving handouts from the “candy shop” that our public lands have become under the Department of Interior (DOI), currently headed by Ken Salazar.

Mr. Salazar, himself a rancher, has perpetuated the handouts of millions of acres to the recipients of “welfare ranching”, i.e. government subsidized grazing rights.

The Bureau of Land Management (BLM), which reports ultimately to Mr. Salazar, issues grazing rights at the current cost of $1.35 per month per “animal unit,” that is, one cow and calf (really two mouths eating grass). A rancher leasing private land to graze would probably pay upwards of $16.00 per month for the same livestock count. More

Fallon, NV (January 19, 2010)— 956 wild American mustangs rounded up off public land by helicopters in the past two weeks now stand in a feedlot-style Bureau of Land Management (BLM) contracted holding facility outside of Fallon, Nevada on private land. The new Fallon facility is not equipped with shelter, windbreaks or protection of any kind for the horses. High winds, rain and snow are expected to continue through the end of the week. In Calico, herds can move to sheltered canyons for protection from the harsh winter weather. Yet, in Fallon, they are deprived of adequate protection despite recommendations from wild horse advocates. This is in direct opposition to BLM’s own standards.
“I’m confused by the double standard. Before members of the public are allowed to adopt a wild horse from BLM we must prove we have adequate shelter. Why doesn’t BLM have to meet the same standards?” asks Ann Evans, adopter of three mustangs.
 
Yesterday, members of the public reported an inhumane lack of windbreaks. No apparent effort has been made to tie canvas tarps on fences to block the howling wind and the anticipated driving snow. On Friday January 15, advocates asked local Nevada BLM staff, Directors and top-level Department of Interior (DOI) under-secretaries to intervene on behalf of the horses by creating wind blocks.  More
