The recent California Public Utilities Commission (CPUC) public meeting in which one resident was told he could have his analog meter re-installed and the SMART Meter removed has resulted in CPUC saying that they would render a ruling on “allowing” citizens to opt out of the system of by 2012. The idea
that CPUC continues to misrepresent their authority and that of PG&E is astounding. The thought that the California legislature and its governor sit idly by, silent, while this travesty takes place against the citizens of their state, is downright disgusting.
Neither CPUC nor PG&E has the right or the authority to violate private property and the rights associated with that, not to mention the assault and violation of the individuals in their persons or bodies. Neither do either of these corporations have the right to summarily and arbitrarily subject the citizenry to the provisions of a private contract they were not party to, and to force them to surrender or submit to what is in fact, a specifically designed military weapon( Bioeffects of selected non-lethal weapons pdf.) that can cause massive harm to the public.
Both CPUC and PG&E are operating under contract law. There are several points that must be adhered to under this system.

The battle over SMART Meters is heating up. Health problems including
headaches are being reported around the country wherever these meters are installed. At this CPUC meeting in California, CPUC commissiner Peevey gives the ok for reinstallation of analog meters. EMF safety network reports this:
On Thursday September 22, at the California Public Utilities Commission business meeting, President Michael Peevey told Chandu Vyas, who’s been suffering from headaches, that he could talk to PG&E and they would provide that he “could go back to the analog meter”. President Peevey directed Mr. Vyas to contact Mr. Sidney Bob Dietz, whose number is: 415-973-5921.
If you want to remove your Smart Meter and have an analog restored, contact Mr. Dietz, or contact Thomas Bottorff, 415-973-3889.
President Peevey could not just allow Mr. Vyas his analog, without allowing others, right?

Santa Cruz Resident Assaulted by “Smart” Meter Installers Wednesday Morning
San Francisco- Yesterday, as part of an “opt out” judicial proceeding at the California Public Utilities Commission (CPUC) the public had a chance to pose tough questions to a panel of utility and “smart” meter supplier executives,
who responded at times by giving false information, vague, tight lipped reassurances, often refusing to answer relevant questions about the power of wireless radiation being emitted by the meters. The judge refused to allow expert medical testimony or public comment on the record or any questions regarding widespread health effects of the pulsing meters.
This morning, Stop Smart Meters! received disturbing reports of an alleged assault by a Wellington Energy Installer on an electrosensitive resident who had demanded the installer halt work installing smart meters on the side of his apartment. Outside at lunch, a boisterous crowd chanted “Pull the Plug,” demanding that the entire wireless “smart” meter mesh network be scrapped, and insisting that any charges to “opt out” of the health damaging “smart” meter program would be akin to charging disabled people to access a wheelchair ramp. As a nationwide revolt is growing against the invasive and costly electric Smart Meters, public utilities and corporations, intent on putting the entire nation under surveillance unlawfully, not to mention creating a massive health threat, are moving quickly to install phase 2 of the SMART GRID: Gas Smart Meters. It won’t stop there; they are planning on rolling out SMART water meters as quickly as possible.
On March 31, 2011 in Capitola California, it was reported that PG & E spokesman Jeff Smith said a total of 17 of the wireless devices were installed on residences and businesses where existing meters had been damaged by floods. Fifteen of the meters were for gas and two were for electric.
The City Council placed a moratorium on Smart Meter installations in February, though the California Public Utilities Commission has sole authority over PG&E.” (This authority over PG&E pertains ONLY to PG&E and cannot be construed and extended to mean authority over private citizens and communitites)
The CPUC has no authority to override a city council inititiative and to move ahead with a private corporate contract between CPUC and PG&E that the public is unaware of, has not seen and did not enter into. More
