THE BATTLE LINES HAVE BEEN DRAWN AS BLACK FARMERS CHALLENGE THE STATE OF GEORGIA AND SECRETARY OF STATE BRIAN KEMP OVER VOTING RIGHTS FOR AFRICAN AMERICANS IN PREDOMINANTLY BLACK COUNTIES AND PRECINCTS IN GEORGIA.

 Black Farmers from south Georgia filed suit against the State of Georgia and Secretary of State Brian Kemp alleging violations of section 5 of the Voting Rights Act, among several claims. The Black Farmers assert that the State of Georgia and The Secretary of State have failed to enforce federal laws and maintain uniformity of legal issues among all the counties that make up the state. In particular, the state and secretary have been alleged, to what amounts to putting on a charade, political gerrymandering. It is without question that the state and secretary knows counties must have preclearance from the Department of Justice or the United States District Court in Washington, D.C. before the counties can shut down polling locations or precincts in predominantly African American counties or precincts.

 However, this will be a showdown of epic proportions. Also named in the petition are The National Republican Committee, The National Democratic Committee, The NAACP, The ACLU, The National Democratic Redistricting Committee, The State Republican Committee and The State Democratic Committee. The Black Farmers are united and have been fighting the USDA for years on similar civil rights issues. An interesting correlation has been drawn by the farmers and the history of questionable stances on civil rights issues by now Secretary of Agriculture Sonny Perdue as former governor of the State of Georgia and his continued stance of denying Black Farmers the right to be heard at the administrative level.

 There is no doubt that the Republican Party is aware of the historical significance of the nomination of Stacey Abrams and her bid to become the first Black Female Governor in the United States. With this nomination, the eyes of the country will be hanging on her every word in regards to policy and civil rights. The Democrats are amassing a war chest for her bid to become the next governor of Georgia, but the Republicans will not be outdone. However, the one factor, that could be the deciding factor, is how Stacey Abrams tackles the issues of Socially Disadvantaged Farmers.

  Socially Disadvantaged Farmers are legally defined as a protected class, to include Black Farmers, Hispanic Farmers, Indian Farmers and White Women. This protected class will be the deciding factor on if Georgia remains a red state or will it be the keystone of the crown jewel that the Dems. are hoping for in November. It is without controversy that former Georgia Governor and current Secretary of Agriculture, Sonny Perdue, inherited an absolute mess at the USDA, an agency that is truly out of control and in desperate need of reform. Black Farmers and Small Farmers Protesting Dollar General and The USDA for Unfair Practices and Filing a Historical Suit Next Wednesday
Location: 201 West Broad Avenue, Albany, GA 31701
Date (and Time): Wednesday, April 25, 2018 (at 10 am.)
On Wednesday, April 25, 2018, the federal courthouse in Albany, Georgia, will be the very location, where a historic and momentous occasion is to take place. A national boycott – against the variety store, Dollar General, Farmers National Bank, CapStar Bank, among other businesses – will commence with the expressed desire to bring attention to the abuse of power committed by Dollar General heirs, Steve and Jay Turner, along with federal judges.
Also, this demonstration will be just one side of the plans for that day. As 1,000 people are expected to appear for this event, which will include a group of African-American farmers, a lawsuit will be filed against the USDA for continued discrimination.
The Georgia Chapter of the African-American Agriculturalist Association’s main complaint is the Secretary of Agriculture at the USDA is not allowing hearings from African-American farmers like he does their Caucasian counterparts.  So, they are desiring to see change and hope that justice will prevail.
In an alliance with the Georgia Chapter of the African-American Agriculturalist Association, multiple civil rights groups, and other groups representing small farmers, the protest is being organized by the Cowtown Foundation Inc., a Tennessee Corporation that specializes in the rights of minority farmers at the administrative level.

Office of Civil Rights was a waste of taxpayer money

1.       Dismantle the Office of Civil Rights- The Administrative Procedures Act allows for the Agency to have 180 days to correct its own mistakes. At any time after 180 days, the farmer can ask for a formal hearing on the merits before the Administrative Law Judge. However, The Agency has more than 14,000 or more pending discrimination complaints that have been shelved as long as or up to 20 years. Even when the farmers ask for a formal hearing on the record, the Administrative Law Judge states that it does not have jurisdiction to hear any farmer with complaints pending before the Office of Civil Rights. Former President Regan exercised great foresight by dismantling the Office of Civil Rights by reasoning that the Office of Civil Rights was a waste of taxpayer money and being used by the Agency to further discriminate against black farmers by inaction.

2.       Immediately return all land foreclosed against black farmers who were Pigford Class Members and did not get a formal hearing on the merits or an adverse denial by the monitor. In addition, all the farmers who lost land and operating equipment that had a pending discrimination complaint that asked for a formal hearing on the merits with the Administrative Law Judge and was denied that hearing, pursuant the moratorium relief provided in the 2008 Food Energy and Conservation Act or otherwise known as the 2008 Farm Bill. The County, State or Federal Court shall immediately issue a writ of possession or no later than 14 days of docketing the complaint or order by the court  to take possession of property by the farmer within 15 days of the Order.
