A $22 million civil RICO case from Cleveland, Ohio has survived another procedural hurdle and appears headed to trial in Cuyahoga county court.
RICO stands for Racketeer Influenced and Corrupt Organization. It was passed by congress and signed into law by President Nixon 50 years ago, in 1970. Originally designed to combat organized crime, the laws’ application has expanded to include any group profiting from an illegal activity.

Investigators say Traci Hudson stole more than $500,000 from a man she had guardianship over.
For the latter part of his life, Maurice Myers lived on his own in a small home south of Sarasota.
Then, in March 2017, when he was 92, Myers was hospitalized twice with numerous health complications. He was released to a rehabilitation facility, then moved to a senior care home in Pinellas Park. There, he’d be closer to his daughter, who oversaw his affairs.
The case highlights the unexpected downsides of court-appointed adult guardianships, which are designed to help the old and the infirm manage their lives but are under fire nationwide amid allegations of neglect, abuse and financial exploitation. Those problems haven’t escaped the watchful eye of Congress, as evidenced by the recent introduction of HR 4174 to enact protections against elder abuse and neglect under guardianship.

What I am about to share with you is unbelievable, yet it is happening around the world. It is the best kept secret of white collar criminals.

I helped my mother escape a fraudulent guardianship in which a judge forced her to give up all of her rights, forced her into an institution where she was drugged and isolated, and forced her to forfeit her entire estate, including her homes and companies to a corrupt guardian that is unrelated to the family. To conceal their crimes, the predators label their theft of her human and civil rights “in her best interest.” There was nothing wrong with my mother. She was simply wealthy and vulnerable due to age, becoming a widow, and trusting two of her own corrupt children. My mother and I made an extraordinary escape in 2016 and now live in exile in Greece. She is originally from Greece. We are both American and Greek citizens. Had I not taken my mother, she would not be alive today. She lost everything to guardianship; I lost everything to save her.
We left with the clothes on our backs leaving our children, grandchildren, homes and our lives behind. After months of hiding, we arrived in Greece with the help of friends, relatives, complete strangers, and the kindness of a representative at the Greek Embassy who granted us emergency passports for our safety.
In most states, if a son, a daughter, or a caretaker:
locks Mom up in her bedroom, blocks her access to the telephone, withholds her personal mail, and refuses to allow her to see her friends and members of her family, that’s a crime, and the perpetrator(s) may be criminally charged, tried, and convicted of elder abuse. But, if Mom is under guardianship, and her guardian forces her into a nursing home against her will and the will of her family, denies Mom a phone, and isolates her from her friends, family, and loved ones, that’s considered “care.”
Guardians currently have the power to isolate the very people whose lives they are supposed to be caring for and protecting. They can do this without the knowledge of the court and without having to justify their actions. In fact, isolation provides an effective and commonly used weapon to wield against any family member who complains about a guardian or the guardian’s decisions.
When a professional or private guardian abuses a person under his or her control, defining it as “protection,” that guardian is immune or quasi-immune from prosecution.
Much to their credit, every member of both the Rhode Island Senate and House of Representatives voted yea to the NASGA~Falk Coalition bill criminalizing wrongful isolation and expanding the definition of “caretaker” to include court-appointed guardians and conservators as well as attorney-in-fact. This was an absolutely huge step forward in the protection of Rhode Island’s current and future senior population, which is the 11th highest in the country at 16.8 % of their total population.
The bill then went to the desk of Governor Gina M. Raimondo, who after some tweeting in her ear by some of her favored “special interest” birdies, chose to veto the bill.

There is currently an act before the Massachusetts Legislature to establish the Office of Adult Guardianship and Decisional Support Services. (S.1177/H3027). The purpose of the bill is to provide guardianship services to “unbefriended” people who are unable to manage their affairs.
“When I see a bill come out that actually addresses the root causes of this epidemic, that holds accountable the people, institutions, associations and agencies responsible; when the federal government stops funding the exploitation of the American public through cash incentive programs hidden in regulations that keep state treasury’s flush with cash, I’ll support those bills. Until then, do not expect me to cheer for these do nothing bills that are nothing more than fluff and buff bills meant to make you think they really do care. They don’t. “
I have watched in dismay as bills have been introduced and/or passed supposedly addressing the trafficking of human beings including the elderly, the disabled and children through the cash incentive systems that fund the buying, selling and trading of the American public. We have been commodified. This system is so rampant and so blatant that we are literally just a step away from auctioning off human beings for profit in the public square. And it wouldn’t be the first time this has happened. The US has a sordid history of selling human beings for profit, only this time around we are all potential property that can be auctioned off.
Having successfully stolen an estimated 3-5 billion annually from the elderly (low estimate) some think the real amount is closer to 10 billion. And, while there are cases of family members, friends, or others in the community who have exploited the elderly and abused them, the vast majority of cases, especially where a large estate is attached, are committed by parasitic individuals who work as predators within and with the cooperation of the probate system, for no other purpose than self-enrichment. These parasites could not care less about the lives they destroy or the misery they cause other human beings.
“Go ahead and see what you can do, because you have been deemed incapacitated, so everything you say or do is meaningless,” said Brenda Uekert, principal court research consultant with the National Center for State Courts. “You can’t even get an attorney, because a judge has already determined that you don’t have the ability to make decisions for yourself.
Two recent bills supposedly intended to address the growing threat of predation of senior citizens who committed the new age crime of aging with assets, address none of the real causes of abuse, neglect, and financial exploitation that occurs under the protection and direction of the so-called “stakeholders” who assembled this system of trafficking, legalizing the conversion of assets from the targeted individuals into the accounts of total strangers whose only interest is self enrichment, is even acknowledged.

“This arrangement will terminate upon your death which will most likely occur right about the time your estate has been bled dry of every penny. If an autopsy was performed at this point with the necessary tox screens, there would no doubt be an unexplainable overload of neuroleptic drugs in what was left of your system. Drugs that your estate, medicare and medicaid will be billed for long after you take your last breath. Only a tox will never be done, in any event.”

In response to the exposure of the corruptive practices now being exposed in probate and family courts, many interested “stakeholders”……such as Guardianship associations, the BAR association, and many in the medical complex are leaning on state legislatures to expand their death grip on the elder community, and to make legal the theft of estates, the stripping of rights and the willful ignoring of standing state statutes meant to protect the victims from the predators.
Some of these new laws seem to heading backwards, but a few are good.
Issues are things like Due process, the role of guardian ad litem, Mediation, guardian background checks, guardianship financial authority, ward’s rights–etc. There are maybe 5 or so states to highlight, including New Mexico, Texas, Tennessee, Idaho, and Nevada.
