Attorney General Maura Healey Blatantly Disregards Elder Deaths – Hastened by Jewish Family & Children’s Service

“My message to Attorney General Healey: the citizens of Massachusetts voted you into office under the blind faith that you were going to uphold your sworn oath of office to protect the citizens of this commonwealth and to prosecute all criminals, including public officials who commit crimes. You owe a duty to elders Beverley Finnegan and Alice Julian to at the very least investigate their deaths that directly occurred because of unlawful hastened death by these public officials.”

Atty. David Schwartz played a key role in the efforts by JF&CS and others in Probate Court Judge Maureen Monks’ courtroom, to end the life of Beverley Finnegan when she was on life support at Framingham Union Hospital.

Massachusetts Attorney General Maura Healey’s Office website explicitly holds out to the public that its mission includes “combatting fraud and corruption,” as well as “investigating and prosecuting crime.” AG Healey further claims that her office combats elder abuse.

Now those claims made by AG Healey all sound reassuring and make you feel protected as a citizen of this commonwealth, don’t they? Beware: this is no different than any other electoral doubletalk. In fact, it’s worse—so let this article serve as an all-points-bulletin that AG Healey’s above-described mission statement does not apply to criminal perpetrators cloaked as probate court public officials and to their agents/representatives.

In a nutshell, after many prolonged under-the-pea shell games played by AG Healey’s staff, in my official role as an attorney, urgently reported substantiated criminal acts of hastened elder death openly and vehemently facilitated by Jewish Family & Children’s Service. As a matter of existing law, hastening of a death is in fact a criminal killing.1

One of the two unlawful deaths that I reported directly to AG Healey pertains to Beverley Finnegan—which death has been previously reported extensively by Boston Broadside and posted online, providing specific details surrounding Beverley Finnegan’s death and the role played by Jewish Family & Children’s Service. The other unlawful death involving Jewish Family & Children’s Service that I reported to AG Healey is that of elder Alice Julian.

After a three-year uphill battle with apathetic officials, files that mysteriously disappeared, several closures of her Aunt’s case with no action, and a pattern of stonewalling by state agencies created to protect patients from abuse and poor care, two things happened: The district administrator of the agency that licensed and monitored nursing homes was fired and Carole Herman, who fought the system for three years, founded FATE, Foundation Aiding The Elderly.

Carole protects the weak, fights the powerful, demands government do its job and doctor’s to fulfill the Hippocratic Oath.

In October 2001 Carole was a Volunteer Spirit Award winner receiving the Lifetime Achievement Award for her work with FATE on behalf of the elderly and in February 2002 Carole was presented with a Resolution from the Sacramento County Board of Supervisors for “her dedication and care for the elderly of our community.”

Today, FATE has affiliated organizations and colleagues fighting elderly patient’s rights in Texas, Kansas, Ohio, Tennessee, Illinois, Nebraska, Oklahoma and South Carolina. FATE has helped families all over the country. Civil actions have been filed on behalf of patients and their families. And the movement to illuminate and reverse the all-too-common incidents of abuse such as neglect, psychiatric drugging and criminal assaults of the elderly is growing.

FATE fulfills a vital and increasing need of providing direct action advocacy and education that will ensure that care is received with the dignity that everyone deserves.

Every time I read about another abusive guardianship case, I feel ill. I cannot help but wonder why Americans are not rising up in droves and calling their representatives screaming “Stop! Enough! This is wrong on every level!”  

Mainstream Media refuses to report on this horrific crime. Why? Because the gravy train is so lucrative that no one wants it to stop….too many people are making too much money by stealing other people’s money. In the case of Dorothy Luck, she is NOT incompetent, but the judge declared her as incompetent because she refused to settle in a lawsuit and simply because he could. Dorothy describes the probate court overseen by Tarrant County Judge Steve M. King as a “well-oiled group of people who can’t seem to find a way to make money except to take it away from other people.”

In Nassau County Supreme Court in Mineola, NY, the late Judge Joel Asarch, along with Mary Giordano (elder care attorney with Franchina and Giordano in Garden City, NY) and Anne Recht, geriatric care manager (AMRecht Assoc in Plainview, NY) worked together often on a number of cases where the elderly victims were kidnapped from their homes and imprisoned against their will in nursing homes. My own mother was one of their victims. Dorothy Wilson, an innocent 87 year old woman, had her beloved home of 60 years stolen from her. She died in prison; penniless, alone and drugged with antipsychotic medication.           

American’s dirty little secret, if the public was truly aware, would understand that this abuse can happen to anyone at any time. “The Public Guardian responded to Margarita’s comments by terminating visitation with her daughter.  The Public Guardian sought and obtained a court order to strip Margarita of her right to meet with elder rights advocates. The Public Guardian has denied Margarita all visitation since November 15, 2013.”

The Monterey County Public Guardian is seeking authority to forcibly administer antipsychotic (psychotropic) medications to conservatee and elder abuse victim Margarita Zelada.  The FDA has repeatedly warned against administration of psychotropic medications to elderly patients.

California’s Department of Aging posted the following comments about use of antipsychotic drugs on elderly patients.

Title 22 of the California Code of Regulations, Section 72018 defines a CHEMICAL RESTRAINT as: “a drug used to control behavior and used in a manner not required to treat the patient’s medical symptoms.” All residents have a right to be free from the use of chemical restraints. (42 CFR §483.13(a); 22 CCR §72527(a)(23); 22 CCR §72319), yet, the use of antipsychotic drugs on those with dementia is common practice and often used as an alternative to the needed care of these individuals.

California’s Notice of Conservatee’s Rights states the conservatee has the right to:

Make his or her own medical decisions

California’s Handbook for Conservators states on page 284:

Psychotropic drugs

Prescription medicines used to alter cognition, mood, or behavior. These medicines are sometimes used to treat persons with dementia. You need specific prior court authority based on a strong showing to authorize the use of these drugs in the treatment of the conservatee.

Violation of Margarita’s rights is nothing new for the Monterey County Public Guardian.  A request for chemical restraint is the latest in a series of violations of rights and denial of due process. More
