EPA Suspends Enforcement of Environmental Laws Indefinitely Due to Coronavirus

1 Comment

Editor note:  Before you read this article, please ask yourself why it would be necessary or of any advantage to suspend any environmental laws?  Who will benefit from this? This is more corporate welfare.

From The Hill

The Environmental Protection Agency (EPA) issued a sweeping suspension of its enforcement of environmental laws Thursday, telling companies they would not need to meet environmental standards during the coronavirus outbreak.

The temporary policy, for which the EPA has set no end date, would allow any number of industries to skirt environmental laws, with the agency saying it will not “seek penalties for noncompliance with routine monitoring and reporting obligations.”

Cynthia Giles, who headed the EPA’s Office of Enforcement during the Obama administration, called it a moratorium on enforcing the nation’s environmental laws and an abdication of the agency’s duty.

“This EPA statement is essentially a nationwide waiver of environmental rules for the indefinite future. It tells companies across the country that they will not face enforcement even if they emit unlawful air and water pollution in violation of environmental laws, so long as they claim that those failures are in some way ’caused’ by the virus pandemic. And it allows them an out on monitoring too, so we may never know how bad the violating pollution was,” she wrote in a statement to The Hill.

The EPA has been under pressure from a number of industries, including the oil industry, to suspend enforcement of a number of environmental regulations due to the pandemic.

“EPA is committed to protecting human health and the environment, but recognizes challenges resulting from efforts to protect workers and the public from COVID-19 may directly impact the ability of regulated facilities to meet all federal regulatory requirements,” EPA Administrator Andrew Wheeler said in a statement.

TransCanada Keystone Pipeline Spill #21

1 Comment

Marti —

In case you missed it — TransCanada’s original Keystone pipeline spilled at least 380,000 gallons of tarsands and toxic diluents into wetlands in North Dakota on Oct. 30.

The spill — the twenty-first (21) spill on the Keystone pipeline since 2010 — led U.S. pipeline regulator PHMSA to order TransCanada to shut down the pipeline again via Corrective Action Order — the fourth such order issued to shut Keystone down since 2010 because “continued operation before corrective action would be hazardous to life, property, or the environment.”

Make sure to add your voice and tell the U.S. State Dept. that TransCanada’s safety record is an unacceptable risk to our land, water and climate, and the Keystone XL pipeline should be rejected as not in the U.S. national interest.

A Foreign Corporation Claiming Eminent Domain?

7 Comments

Marti —

You may have already heard, but TransCanada just filed new eminent domain claims in court against 90 Nebraska family farmers and ranchers — including my family — who refuse to give up our land for this foreign corporation’s Keystone XL tarsands export pipeline. [1]

TransCanada has been bullying my family and other Nebraska landowners for the past ten years, seeking land that’s been in our families for generations for a pipeline that threatens our farms, our water, and our climate. Now this foreign corporation has filed a lawsuit against my family, and dozens of other farming and ranching families, and intends to abuse eminent domain to take our land for KXL against our wishes.

We have less than a month from today to respond in court, and oppose TransCanada’s eminent domain lawsuits. We need your support in this moment more than ever before.

Give $25 or what you can to support landowners fighting TransCanada’s new eminent domain lawsuits to push KXL through our farms and ranches.

TransCanada is attempting to make some waves and put up a smokescreen to make investors think KXL is a “green-light,” when there remain serious obstacles in this pipeline’s path. The company has said it plans to engage in “pre-construction” activities along the proposed route for KXL, like clearing trees.

Landowners like my family have stood together for ten years, and we intend to fight these new eminent domain lawsuits. Bold supporters like you have also stood with the landowners during this decade-long fight, and we thank you.

Donate to Nebraska landowners’ legal defense against TransCanada’s eminent domain lawsuits for Keystone XL.

Thank you for continuing to stand with us.

Jeanne Crumly, Nebraska landowner in Holt County

U.S: Hormone-Disrupting Weed Killer Taints Tap Water for Millions in Corn Belt

Environmental Working Group (EWG) | November 14, 2018

WASHINGTON – Seasonal spikes of atrazine – a weed killer that can disrupt hormones and harm developing fetuses – contaminate drinking water in corn-growing areas of the Midwest and beyond, according to an analysis of federal records by the Environmental Working Group.

Environmental Protection Agency data show that in some Corn Belt communities, atrazine levels can spike three to seven times above the legal limit in late spring and early summer. But by avoiding water testing during peak periods, some water utilities stay in compliance with drinking water regulations – and don’t have to tell customers they were exposed to a hazardous chemical in their tap water.

“Our investigation found that nearly 30 million Americans have atrazine in their tap water,” said Olga Naidenko, Ph.D., EWG senior science advisor for children’s environmental health. “But many may never know, because outdated federal policies allow utilities to test for atrazine before or after the spike.”  READ MORE HERE

The Trump/Chilean/Antofagasta/Twin Metals/Northeast Minnesota/Copper Mining Connections

By Gary G. Kohls, MD – 11-13-2018

Pictured above are Jared Kushner, Ivanka Trump, Andrónico Luksic Craig and the $5.5 billion Washington, DC town house that Kushner and Trump leased from Luksic, the CEO of Antofagasta Holdings and the richest man in Chile. Luksic purchased it the week after Donald Trump won the election and immediately leased it to Kushner.

Iván Arriagada Herrera, the CEO of Antofagasta Minerals S.A. (since 2015) and Antofagasta plc (since 2016) said that Donald Trump’s election has created a “more favourable climate for the development of the (Northern Minnesota Twin Metals) project.”

Arriagada recently said that Antofagasta’s Twin Metals unit was preparing an environmental impact assessment for an underground copper-nickel mine in Minnesota. (Twin Metals was a Canadian Penny Stock mining company until Antofagasta acquired 100% of the company’s shares a few years ago.)

But the project hinges on the resolution of a legal dispute with the US government, which under former President Barack Obama, refused to renew the company’s mineral leases in 2016 to protect the Boundary Waters Canoe Area Wilderness area from possible pollution.

But the dispute would still need to be settled in court, he said, adding: “We’ll keep defending our right to develop the mine.” Trump’s election makes the deal much more likely to happen, given the strong pro-extractive business climate of the Trump administration.

When Guillermo Luksic died in 2013, his older brother Andrónico Luksic stepped into the role of CEO of the Luksic Group (that their Croatian/Bolivian father had founded) and several of its related companies, notably Quinenco S.A., the holding company for the family’s non-mining investments. Andronico decided to concentrate on consolidation of the group and on building strong positions for the new acquisitions.

Andronico is also CEO of Compañía Cervecerías Unidas S.A. and its subsidiary companies CCU Chile, CCU Argentina and ECUSA, vice chairman of Compania Sud Americana de Vapores S.A. (CAV), of Banco de Chile and a member of the board of directors of Madeco S.A. (renamed Invexans), and Sociedad de Fomento Fabril (SOFOFA). He is member of the International Advisory Council of Barrick Gold, the Brookings Institution, the Panama Canal Authority, the Chairman’s International Council of the Council of the Americas, International Advisory Council of the President, board member of the Chilean Pacific Foundation and is a member of the Latin American Council of Nature Conservancy.

Andrónico Luksic is also a member of the Boards of Antofagasta plc and Antofagasta Minerals.

The Luksic family is one of the richest families in the world. The founder’s second wife is worth $20 billion, At one time she was the 33rd richest person in the world.

Barrick Gold Corporation is the largest gold mining company in the world, with its headquarters in Toronto, Ontario.

“From ciproispoison.com:Cipro-induced toxicity syndrome wreaks absolute havoc on every part of a person’s body–every tendon and joint in the body can become affected, every organ (including the brain), peripheral nervous system (resulting in severe and potentially permanent pain conditions, dystonia, muscle weakness or autonomic dysfunction), … long lasting or permanent central nervous system damage (including relentless insomnia, memory problems, random panic, depersonalization, psychosis), … and on and on… .”

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
A study published by Mayo Clinic found almost 70 percent of Americans are on at least one pharmaceutical. Antibiotics top the list, followed by antidepressants and pain killers. Fluoroquinolones (also called “quinolone” or just “quin”) are one of the most commonly prescribed antibiotics in the USA. In 2011 a staggering 26.9 million prescriptions for oral and IV fluoroquinolone antibiotics were prescribed for routine infections.
Cipro, the ‘stellar’ fluoroquinolone burst into the media spotlight during the so-called anthrax scare on the heels of 9/11. Other popular fluoroquinolones are Levaquin, Avelox, and Floxin. Fluoroquinolones are actually deadly indiscriminate chemotherapy drugs, which Big Pharma reinvented as antibiotics and aggressively marketed.
Although all Big Pharma antibiotics are problematic and dangerous, fluoroquinolones are in a class all their own. Their potential for serious, often permanent harm and even death are becoming legendary -not because of FDA, or Big Pharma oversight, but because those who have been severely injured and disabled by fluoroquinolones are speaking out in droves on numerous internet forums, communities and facebook groups.
In 2008, the FDA (Fraud and Death Agency) reluctantly required some fluoroquinolone antibiotics to include a black-box warning; ironically, Cipro now carries two warnings. In fact, half of all fluoroquinolones have been removed from the market due to their dismal safety records, yet those remaining have yet to be proven any safer.
The Freethought Project
Tylenol the most popular drug taken in the US Kills Your Empathy. One Quarter of All Americans Take Tylenol Every Week & downing it with a nice glass of Fluoride…..well you get the picture.
Notice the “fluo” part in Prozac’s chemical name, fluoxetine. It denotes the drug’s main active ingredient: fluoride. Fluoride robs people of their will; and makes people easier to control. Makes you apathetic. US Government Admits: Americans Have Been Overdosed on Fluoride For Decades: bit.ly/GovOverdose
Pharmaceuticals are literally numbing people and preventing them from experiencing positive emotions!! Please reconsider taking any pain killers, if you’re experiencing pain dive deeper and listen to what your body is really telling you and look into natural ways of remedying the pain. There are alternatives that don’t have detrimental & lasting chemical effects on your ability to be and feel HAPPY.
“If you take Tylenol to ease your pain, you might actually be experiencing an unexpected side effect: apathy. New research shows that acetaminophen, the main ingredient in Tylenol, can dull positive emotions as well as any pain you’re feeling.
Here is an incomplete list of some of the culprits:
A) Foreign Mining Corporations (PolyMet, Glencore, Twin Metals, Antofagasta, etc);
  1. Minnesota’s Elected Politicians/Accomplices (both Corporate-influenced “Liberal” Democrats, and “Conservative” Republicans);
  2. Minnesota’s “Regulatory” Agencies that are Supposed to be “Natural Resource Protectors” (Including the DNR, the PCA, and the US Forest Service); and
  3. Most Area Newspapers; Most Area Television Stations; All the Area’s Chambers of Commerce; Minnesota Power (Electric Utility); the Trump Administration; Regional Labor Unions: and Dozens of Suppliers/Businesses that will Temporarily Profit from Supplying the Mining Industry While Simultaneously Risking the Permanent Poisoning of the St Louis River Watershed, Including Lake Superior
This column will point out and try to de-mystify some of the often-perplexing developments in the decades-long debate concerning allowing foreign mining corporations (which could justifiably be considered “Undocumented Aliens”) to invade water-rich northern Minnesota in order to extract our state’s non-ferrous metal deposits- for the selfish enrichment of its foreign shareholders and management, none of whom really care about the long-term consequences to the state’s precious water resources.
Everywhere in the world where copper mines have been dug and the poisonous tailing’s ponds have been installed, there has not been a single one that has not permanently polluted the ground water and the downstream watersheds, often catastrophically, see the list of 100 of them at . State of the art copper sulfide mines inevitably produce as an inevitable by-product sulfuric acid and many other toxic substances that poison the soil, air, ground water, nearby aquifers, lakes and downstream rivers, especially in water-rich environments like northern Minnesota. Requesting honest information from the Minnesota DNR, the Minnesota PCA and the US Forest Service regarding the latest PolyMet project permit application:
Please respond to the concerned folks to which this email has been cc’ed, all the details of the permit that the foreign corporation Glencore has submitted to the MNDNR, MNPCA, or US Forest Service concerning the establishment and maintainance of their enormously dangerous, potentially catastrophic, toxic tailings lagoon, an entity that seems to have been conveniently ignored by the media cheerleaders and even you regulatory entities.
I don’t recall seeing any permit application published for the eventual 250 foot high earthen dams that will hold back for eternity the tens of millions of cubic meters of poisonous liquid sludge that the copper/nickel/sulfuric acid mine will inevitably produce (and need to be stored).
Anybody with any awareness of the risks of the toxic metal and sulfuric acid recognizes that the tailings lagoon MUST be the center of discussion. So far it is rarely mentioned in the occasional news bulletins.
Every copper/nickel liquid tailings pond holds the 99.8% mine waste plus the liquids that is used to pipe the dissolved powder from the processing plant to the pond.
Every copper/nickel sulfide mine in the history of mining has leaked/leached poisons into the groundwater, onto adjacent lands and into the downstream environment. This happens at all copper mine sites that are located in watery environments such as northern Minnesota. More
Duty to Warn
By Gary G. Kohls, MD – 9-19-2017
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

To the Minnesota Department of Natural Resources (DNR), regarding PolyMet’s most recent permitting request:

(Email address: NorthMetPermitting.DNR@state.mn.us):

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Here are my reasons that the DNR should reject PolyMet’s permit applications for their earthen tailings dam, their liquid slurry pipeline pumping operation and their open pit sulfide mine near the headwaters of the St Louis River:
For starters, it is critically important to understand that the foreign Penny Stock company called PolyMet has a current share price of $0.63 per share, down from $1.50 per share in 2014. PolyMet, a total amateur in the business, has never operated a single mine in its short corporate life nor has it earned a single penny from mining. Their only income comes from selling shares to speculators and borrowing money from investors to pay their executives and employees. In addition, PolyMet, being an inanimate money-making corporation (that by definition has no conscience), cannot be trusted to tell the public about all the risks to the environment (including wildlife, fish, water, soil and air) that their exploitation of the earth could generate.
Therefore PolyMet can be expected to hide the fact that their operations could easily cause a massive environmental catastrophe similar to what happened at Mount Polley, British Columbia in 2014 (carefully study the article further below for the frightening details). Mount Polley was a state of the art copper mining operation.
Every citizen stakeholder that is potentially adversely affected by PolyMet’s operatioin deserves to be fully informed by (theoretically) unbiased regulators such as the MN DNR about the potentially catastrophic risk to the water users who happen to live downstream from the massive tailings lagoon, whose (eventual) 250 foot high earthen dam is at a high risk of failing in some way or other sometime in the future, especially in the event of a large deluge of rain, an earthquake or a design flaw that could cause the earthen dam to dissolve, leak, over-top or structurally fail in some other way, including being damaged by sabotage. The risks will exist for eternity, since the toxic metals (see list below) in the lagoon will never degrade into non-toxic forms.
In addition, the vulnerable pipeline that will carry the toxic sludge from the processing plant to the slurry pond is at high risk of sabotage, with serious environmental contamination that could possibly be even worse than the bursting of a dirty frack oil pipeline such as could happen from the foreign pipeline company Enbridge as it transports dirty oil from the tar sands in Canada or from the Bakken oil fields in North Dakota. I don’t believe that PolyMet has dealt with the possibility of sabotage.
Up to this point, both PolyMet and Twin Metals (and all of the governmental agencies that have been involved in the approval process) have been seriously neglectful in educating the public about all the potential lethal dangers of either the pipeline or the massive amount of toxic liquids that will forever cause the deaths of any water bird that lands on the lake-like lagoon (a la Butte, Montana’s ever-lastingly poisonous mining tailings “pond” and the nearby defunct Berkeley open pit mine [now a toxic “lake”] that has had its water pumps shut down and is now nearly filled to the brim with poisonous water that has high levels of dissolved toxic metals and a pH approximating that of stomach acid!). Security Firm Running Dakota Access Pipeline Intelligence Has Ties to U.S. Military Work in Iraq and Afghanistan
TigerSwan is one of several security firms under investigation for its work guarding the Dakota Access pipeline in North Dakota while potentially without a permit. Besides this recent work on the Standing Rock Sioux protests in North Dakota, this company has offices in Iraq and Afghanistan and is run by a special forces Army veteran.
According to a summary of the investigation, TigerSwan “is in charge of Dakota Access intelligence and supervises the overall security.”
The Morton County, North Dakota, Sheriff’s Department also recently concluded that another security company, Frost Kennels, operated in the state while unlicensed to do so and could face criminal charges. The firm’s attack dogs bit protesters at a heated Labor Day weekend protest.
Law enforcement and private security at the North Dakota pipeline protests have faced criticism for maintaining a militarized presence in the area. The American Civil Liberties Union (ACLU) and National Lawyer’s Guild have filed multiple open records requests to learn more about the extent of this militarization, and over 133,000 citizens have signed a petition calling for the U.S. Department of Justice to intervene and quell the backlash.
The Federal Aviation Administration has also implemented a no-fly zone, which bars anyone but law enforcement from flying within a 4-mile radius and 3500 feet above the ground in the protest area. Dallas Goldtooth, an organizer on the scenes in North Dakota with the Indigenous Environmental Network, said on Facebook thatDAPL private security planes and choppers were flying all day” within the designated no-fly zone.
Donnell Hushka, the designated public information officer for the North Dakota Tactical Operation Center, which is tasked with overseeing the no-fly zone, did not respond to repeated queries about designated private entities allowed to fly in no-fly zone airspace.
What is TigerSwan?
TigerSwan has offices in Iraq, Afghanistan, Jordan, Saudi Arabia, India, and Latin America and has headquarters in North Carolina. In the past year, TigerSwan won two U.S. Department of State contracts worth over $7 million to operate in Afghanistan, according to USASpending.gov.
TigerSwan, however, claims on its website that the contract is worth $25 million, and said in a press release that the State Department contract called for the company to “monitor, assess, and advise current and future nation building and stability initiatives in Afghanistan.” Since 2008, TigerSwan has won about $57.7 million worth of U.S. government contracts and subcontracts for security services.
Company founder and CEO James Reese, a veteran of the elite Army Delta Force, served as the “lead advisor for Special Operations to the Director of the CIA for planning, operations and integration for the invasion of Afghanistan and Operation Enduring Freedom” in Iraq, according to his company biography. Army Delta partakes in mostly covert and high-stakes missions and is part of the U.S. Joint Special Operations Command (JSOC), the latter well known for killing Osama Bin Laden.
One of TigerSwan’s advisory board members, Charles Pittman, has direct ties to the oil and gas industry. Pittman “served as President of Amoco Egypt Oil Company, Amoco Eurasia Petroleum Company, and Regional President BP Amoco plc. (covering the Middle East, the Caspian Sea region, Egypt, and India),” according to his company biography.
“Sad, But Not Surprising”
Investigative journalist Jeremy Scahill told Democracy Now! in a 2009 interview that TigerSwan did some covert operations work with Blackwater USA, dubbed the “world’s most powerful mercenary army” in his book by the same name. Blackwater has also guarded oil pipelines in central Asia, according to Scahill’s book.
Reese advised Blackwater and took a leave of absence from TigerSwan in 2008 in the aftermath of the Nisour Square Massacre, a shooting in Iraq conducted by Blackwater officers which saw 17 Iraqi civilians killed. TigerSwan has a business relationship with Babylon Eagles Security Company, a private security firm headquartered in Iraq which also has had business ties with Blackwater.
WATER WARS
Well water, in the photo, remains plentiful at Venetucci Farm, Colorado, but water law requires purchase of an almost equal amount of “allocated” water before they can pump. Sources for allocated water are becoming harder to find.
Since 1992, a systematic attack on agriculture and food production in the United States has been developing, however the West has bore the brunt of this highly purposeful agenda which began with President Clinton in 1993 and is currently being promoted in California by the courts and Governor Brown. Consequently, ranchers have had their long-existing grazing and water rights methodically stripped away on Federal land and now private lands as well. Agricultural interests have been relentlessly sued by environmental groups and then over-regulated by the government.
Here is an example:  The California State Water Board, recently invoked an emergency water allotment regulation without due process. Since January 2015 major changes have been made in the State of California with regard to private wells and ground water. There is now a new move by Governor Brown who recently signed a bill that changed water laws in the fall of 2014, which undermines the people’s property rights where private wells all over the state, will begin to be metered wirelessly by satellite. It is foreseen that the next step will eventually be mandated flow meters on pipelines coming from lakes, canals, creeks and rivers.
Already, state water agencies and/or community water districts have begun to implement allotment controls which allows the monitoring of well water meters and includes the use of fines and enforcement. I am familiar with someone in Northern California that was recently forced by P.G.& E. to put in a smart meter on his new well, and yes, it was mandated.
If local government takes this a step further and mandates flow meters on irrigation pipelines coming from a variety of water sources, there will very well be a limit to the amount of water that may be taken. What is now transpiring more and more is a rogue and unconstitutional government that is on a mission to monitor and control water locally and this fact is already happening in other states. Presently, broad government overreach, in matters of personal needs, such as food, water, shelter, & electricity, is off the charts. And let’s not forget about the other issues such as saving the frogs and toads by eradicating thousands of trout in the Sierras. There are thousands of other “endangered” species that are all part of a massive, decades old agenda that includes a tidal wave of lost rights and jobs.
Tamarack Lake photo1                                                Tamarack Lake
As “we the people” entered into the year 2016 and beyond, were they aware of the plague that was consuming our country? It came at first as a black cloud creeping along the city streets and then entered through the crevices of our windows and doors and finally made its way into the very rooms of our houses. It began to sedate the masses into a near slumber but then retreated and continued following a path to higher ground. I followed the cloud as it rose above the hills and then began to touch the waters, the lakes and the rivers. It continued then to the higher elevations and to the utmost parts of the wilderness areas. There, the cloud stayed for a very long time over the vast Sierra Nevada Mountains until a mighty wind began to take it eastward.
Now, I was on a quest to find out a lot more about this strange phenomenon. Besides the cloud, there were other factors responsible for another findings that began to surface in my investigation.  A trail of total devastation had found its way to the deepest parts of the sea to where 1/3 of all living things had died. While this fact had been covered up by government and the mainstream news, another gigantic black cloud spread out for hundreds of miles and continued to engulf hundreds of cities, thousands of factories and countless places of business which were all then forced to close. As the plague reached the Central Valley, the massive network of waterways from the Sacramento Delta down to Bakersfield, began to trickle away and then thousands of orchard trees began to die. The devastation was overwhelming but then I made another observation.
THE DROUGHT & THE SMELTDOWN AT THE DELTA?
____________________________________________________________
In the last five years, California, in conjunction with the U.S. Fish and Wildlife Service, has flushed nearly a trillion gallons of State Water Project water into the ocean in support of a bait fish
called the Delta Smelt. So there’s not enough water for domestic use?
Since when and how did the mainstream media miss this one? They didn’t. They just refused to report it.
Just a little bit of censorship here and a little there, but none dare call it Newspeak which is the term taken from George Orwell’s 1984 which explains how the media and school textbooks secretly uses bias for the sake of those elite players at the national level, while clouding the political landscape, and promoting the use of politically correct
terms such as “Climate Change.” Compromised freedom of speech and the prevention of the flow of ideas is the endgame which is controlled by the Newspeak machine and the careful manipulation of the English language.
So in this process, a $45 billion agricultural industry in the Central Valley ends up being decimated, all the while the smelt take precedent over the people and our food production. So Californians must now ask themselves why is Governor Brown, the courts, the environmentalists, and the legislature on a mission to prevent all people and the farmers from having natural rights to their own water?
The statewide water system was designed with the peoples tax dollars to benefit domestic needs first while fish survival would still be provided for through a secondary measure with a system of dams to
where water would be released in measurable amounts for spawning. And in spite of what the news media reports, there is still enough water to go around unless a person wants to believe that it is still
important to allow nearly a trillion gallons of water to go to the ocean while food prices are soaring and foreclosures in the Central Valley are ongoing.
What else could one expect from a government which is run by a bunch judges and legislators who care more for the livelihood of fish and critters than the people.
Let’s not forget that the Central Valley water system was designed decades ago to withstand a 10 year drought. Then why was an estimated 400,000 farm acres taken out of production last year and how
many more acres will be taken out this year?
So where’s the bulk of the water ending up? It’s on its way either to Southern California for domestic use and swimming pools or ending up in the ocean while America’s richest farmland lies fallow boosting the prices of food nationwide. And this is a government for and by the people? I am afraid not. It is a government that does exactly what it wants to no matter how the people vote or what they think. Will saving rainwater falling into our rain gutters become the next illegal act signed by the governor?
The P.G.& E. is already requiring smart meters on all of the new wells that are going in. If persons are drawing too much water from their well will they be fined or will their well pumps just be turned off automatically via satellite? Control the water and the food of the world and you will control the people.
Las Vegas Water Grab Appeals Rejected by Nevada Supreme Court
 Las Vegas Water Grab Appeals Rejected by Nevada Supreme Court
Opponents of the controversial proposal to pump and pipe groundwater from a vast region in eastern Nevada to Las Vegas say a Nevada Supreme Court ruling bolsters their case that the pipeline project can’t pass scientific, environmental or legal muster.
Great Basin Water Network believes that the February 6, 2015, ruling by the Nevada Supreme Court (15-04004) should be the final death knell of the ill-conceived and unsustainable project proposed by the Southern Nevada Water Authority (SNWA) and approved by the Nevada State Engineer. More
New state “super priorities” now places habitat protection first (yellow-legged frogs), health and safety next (humans), and agriculture last in regard to water. Previously, the priorities were listed as human consumption first, then agriculture, then habitat preservation.”
Wildfire Severity
On August 26th the Nevada County Board of Supervisors (BOS) unanimously passed a resolution “declaring an ongoing emergency due to the … threat of wildfire in Nevada County, and urging the Governor of California to take an active role at the federal level to demand that the federal government take action…” That may sound like a great idea to many, but there may be more to the picture.
On July 22nd the Sierra County BOS was the first to sign a county “Proclamation of Local Emergency” resolution. In the supporting documents provided regarding that agenda item, there was far more information than what is seen in their resolution.
Sierra County wants the governor not only to get involved, but to “seek concurrence of the President of the United States over the Sierra Nevada-wide declaration of local emergency.” Do we need – or want – an Executive Order (EO) from the President to dictate to our county what will be done in our forests? Currently there are laws in place that require the federal government to harmonize with county plans when making decisions about public land within the county. Could an EO end that? More
We all know what the term, Supreme Law of the Land, means. The California State Constitution sets forth in Article I, Sec. 25, “The People shall have the right to fish upon and from the public lands of the State and in the waters thereof, excepting upon lands set aside for fish hatcheries, and no land owned by the State shall ever be sold or transferred without reserving in the People the absolute right to fish thereupon; and no law shall ever be passed making it a crime for the People to enter upon the public lands within this State for the purpose of fishing in any water containing fish …”
Nonetheless, a criminal complaint is proceeding within the Tehama County Superior Court, California, seeking prosecution of Don Bird for executing his constitutional right of fishing upon the open waters of California. Below is his argument in his defense;
I have a mandatory appointment with the Tehama County Superior Court    September 23, 2013 at 1:30 PM. My “Fishing Without A License” citation (so called infraction) will be my  showcase Declaration of Three of our Constitutional Rights. The following Quotes should enlighten the Judge to  dismiss this citation because my plea will be “Innocent”  until Proven Guilty.
“The  state cannot diminish rights of the people”  And in Bennett v. Boggs, 1 Baldw 60,
“Statutes that violate the plain and obvious principles of common right and common reason are null and void.”
Would we not say that these judicial decisions are straight to  the point – that there is no lawful method for government to put restrictions or limitations on rights belonging to  the people? Other cases are even more straight forward:
“The assertion of Federal Rights, when plainly and reasonably made, is not to be defeated under name of local practice.” Davis v. Wechsler, 263 US 22, at 24
“Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate  them.” Miranda v. Arizona, 384 US 436, 491.
” The claim and exercise of a Constitutional right cannot be converted into a crime.” More
Solutions for attacks on property rights Event
SISKIYOU COUNTY – Ranchers, property owners and Constitutional groups from four Western states will meet at the top of California to discuss solutions to protect private property rights; and open roads in USFS managed lands.
Siskiyou County, California, and neighboring Klamath County, in Oregon, feel plenty of heat as fights over water, wolves and closed Forest Service roads slam in waves one-after-the-other.
Much of rural America feels the heavy-hand of demands from government agencies, Tribes and Enviro NGOs. Yes, ranchers along this Klamath River area are surrounded by over-regulations and greed.
Recently, the Klamath Tribe exercised its priority Water Right in Oregon and shut-off the water to 115,000 acres of pasture and hay ranches affecting over 80,000 head of cattle. And ranchers, along with home owners in Siskiyou County, are fighting a lawsuit to save their Water Right from the Karuk Tribe and NGO Klamath River Keepers.
But in this stifling mud and muck, solutions have been found. They just need to be learned and applied, according to three ranchers that will be speaking July 20-21 at the Liberty and Property Rights Coalition Events in Siskiyou County. Admission is free.
“This is the caper,” said Ramona Hage Morrison, whose family has fought one of the longest battles in the West to protect their Water and Grazing Rights in Nevada.
“They have hood-winked the property owners. Most don’t understand their property rights, but we can fix that,” smiles Hage-Morrison.
Yes, in the face of constant threats, Hage-Morrison is upbeat. Her family has won major “rights” issues in federal court over the US Forest Service and Bureau of Land Management. She will be sharing the line of defense that worked in Hage “takings” case and their “forage right” case.
The Liberty and Property Rights Coalition Event will be held at the Yreka Community Theater, at 812 North Oregon Street in Yreka — at the north end of town. Take the third off-ramp from I-5 exit 775. Time is 1 to 4 p.m. on Sat. July 20th. Several motels are in close proximity of the Event.
Then on Sun. July 21st, Butte Valley Protect our Property is hosting the Event at the Dorris Community Center, again at the north end of town on Highway 97.  Time is 2 to 5 p.m.
“This is a celebration,” said organizer Debbie Bacigalupi, “and we are going to learn from those who have won. We are energized as this historical meeting brings property owners from four states into one Event.”
Arizona Rancher Danny Martinez worked with the Hage’s on their lawsuits and used what he learned to defend his ranch from the federal agencies. Martinez will share the remedies he has found. Bring your notebook.
Then Casey Anderson, a rancher from Idaho, will have a slide show on the federal mismanagement of wolves.
Michael Shaw, who just won a significant lawsuit over his property rights against Alameda County, will be serving as Master of Ceremonies for both meetings.
Minnesota House And Senate: Stop Mandatory Fluoridation
Petition by
Loren Cramer
Minnesota statute, (144.145) requires the fluoridation of the municipal water supply.
Hydrofluosilicic Acid is an industrial by-product of the phosphate industry that is added to the water for the, “prevention of tooth decay.” This chemical is too toxic to be legally discharged into the environment. Fluoridation of the water supply violates the ethic of informed consent set forth in the Nuremberg Code and is bad medical practice. Fluoridation has never been proven, “safe and effective,” with substantial evidence. According to the FDA, fluoride is a “drug.”
By this definition, the practice of fluoridation has been used as a massive experiment in Minnesota for over 40 years.
MD’s are required to evaluate their patients prior to prescribing drugs and should also do follow up, yet fluoride is being forced on an entire population without regard for the dose received from water and other sources. Decision makers should not be able to do to the entire state what doctors cannot do to individuals.
To universalize the concept of medicating the water without informed consent makes it morally wrong. One size does not fit all. Medicating the water for the, “greater good” takes away autonomy especially for those who can’t afford filtered water.
Because something has been done for a long time does not make it safe or just.
The fuel additive lead was once thought to be safe. The precautionary principle and due diligence have been ignored for way too long. In 2011 the EPA and HHS lowered the recommended amount of fluoride due to high rates of fluorosis.
Fluoride toothpastes are required to carry poison warnings, yet parents are not warned about ingesting fluoride and it’s potential developmental hazards.
The EPA has classified fluoride as a, “Chemical with substantial evidence of developmental neurotoxicity.”
No rational person would call for a chemical to be added to the water that could cause brain damage. Fluoride is the active ingredient in many pesticides and is linked to increases in bone cancer, thyroid dysfunction, bone cancer, and lower IQ’s.
To:
Repeal Minnesota statute, (144.145)
Sincerely, [Your name]
How the Elite Intend to Achieve Their 90% Reduction in Population
This is how the world ends, not with a bang, but with a whimper.”
Many imagine an Orwellian nightmare world in which people will be rounded up and shot en mass, like Hitler, Stalin, Mao and Pohl Pot disposed of their “undesirables.” However, the actual means by which the elite will achieve their 90% reduction in world population will be much subtler than that – and you won’t even see it coming.
In fact, the job is already half done. The abortions, sterilzations, contraception and the effects of social engineering that have occurred over the last fifty years have already taken their toll and the effects of this will continue well into this century.
While some who consider themselves to be aware are railing against “zero population growth” policies, the fact is that the nations of the developed West have already passed the threshold of “zero population growth,” years ago, and are now into population decline.
The effects of this can be seen mostly in Europe, in particular, Russia and Germany, but it affects the whole of Europe. Also affected is Japan and the deaths that have occurred from the recent earthquakes and tsunamis there, as well as those that will result from radiation, only add to the problem. Not only is population decline occurring in Europe and Japan, but also in the United States, Australia, Asia, Mexico, and even in the Middle East, contrary to the popularly held idea that the Third World’s population is “exploding.” This is all being driven by the same factors affecting birth rates in western nations, of course, as these factors are indiscriminate and global.
Thus, it is a demographic fact that, by 2050, the world’s population will plateau at 9 billion and then precipitously drop like a rock throughout the remainder of the century. This is not a “theory,” it is not even a prediction. It is a fact and is guaranteed to occur, due to the aforementioned means of population reduction that have already happened.
But, this is to say nothing of the effects that will be added to this by the current covert means of depopulation that we are being continually assaulted with right now. Aside from the usual effects of the toxic food, water and air we take in, there is the unseen specter of Bisphenol-A (BPA), which is used as a softener in plastics, from the toys your child plays with to the plastic wrap you put last night’s GMO leftovers in. BPA, which is virtually unavoidable if you live in the modern world at all, is everywhere and is responsible for ensuring a large part of the decline in births by rendering the males of all species sterile.
So, while it is inevitable that the population will decline throughout the twenty-first century, the decline will be greatly accelerated and deepened by the hundreds of chemical and biological agents we come in contact with on a daily basis.
Inventive Spelling
It is called “invented spelling” or “inventive spelling,” and many teachers encourage it in the early grades. It’s not because they’ve given up teaching children to spell, but because of a general shift in understanding about how children learn.
When children create their own spellings for words they do not know how to spell correctly they’re using invented spelling. They use what they know about letters, sounds and spelling patterns to spell the word as well as they can.
Written in standard spelling, the above excerpt from a first-grader’s story would say: “There once was two flowers. One was pink and the other was purple. They did not like each other because they were different colors. One day they had a fight.”
 I diagnose dental fluorosis on average 5 times daily, but fluoride doesn’t only affect teeth, it can potentially affect the brain and nervous system, kidneys, bones, and other tissues in young children during their critical stages of organ development. A public awareness campaign is urgently needed
A new study confirms infants fed formula reconstituted with fluoridated water are at greater risk of developing discolored teeth (dental fluorosis). (1) The American Dental Association (ADA) warned dentists about this in 2006 but has done little or nothing to inform the nearly 200 million Americans who live in communities with fluoridated drinking water. Farm Wars
What do Codex Alimentarius with its official food standards, the fluoridation of our water and food supply, genocide at the Auschwitz concentration camp, and Monsanto, the company responsible for genetically altering the world’s food supply all have in common? Is there a connection that binds these seemingly diverse organizations together? Yes, there is. In fact, they are so inextricably bound that separating them is all but impossible.
THE MINING OF OUR AQUIFERS
“Meanwhile, the Department of Interior’s Bureau of Land Management is rounding up our wild horses with a vengeance because there’s “not enough water for them to drink.”  (A horse only drinks about 10-15 gallons of water a day.)  It seems that DOI Secretary Ken Salazar has spent all of his time envisioning the “new direction” with his Wild Horse and Burro Initiative, which will take our wild horses off their federally protected lands and use taxpayer money to put them on preserves.”
Just one mine in Nevada (Barrick Gold’s Goldstrike Mine) has pumped over 383 BILLION gallons of water from an aquifer.  (and that was a 2005 statistic, so it’s much more than that by now)  According to a New York Times article by Kirk Johnson, nearly 10 million gallons of water a day is draining away from the driest state in the nation. California: Water Board Chooses New Delta Watermaster
3 Comments
Op-Ed
by Dan Bacher
The last thing that the California Delta needs is a new bureaucrat to further Governor Arnold Schwarzenegger’s plans to build a peripheral canal and new dams, but that’s exactly what we now have.
The five members of the State Water Resources Control Board recently chose attorney Craig M. Wilson to serve in the newly created Delta Watermaster position – and representives of environmental groups and California Indian Tribes weren’t impressed.
The Sacramento-San Joaquin Delta Reform Act of 2009, part of the legislative path to the peripheral canal that was rammed through the Legislature by Senate President Pro Tem Darrell Steinberg and Governor Arnold Schwarzenegger last November, requires the State Water Board to appoint a “Delta Watermaster.” The Delta Watermaster has the authority to monitor, report and take enforcement actions on the Delta. FAN Bulletin 2020: Two phenomenal days in fighting fluoridation
The most exciting days for FAN are when we learn that fluoridation is stopped in a particular city or town. However, the last two days have been outright phenomenal – and all because Dr Mercola takes his job seriously.
Yesterday morning when I woke up I was thrilled to see that the Mercola-Connett video interview/commentary had received 8,000 “views”. By 6 am the total was up to 12,000. By noon the total rocketed to 92,000 and by 1 pm it surpassed 100,000. By 9 pm we had gone over 150,000 and by 11 pm it had reached 158,000. This morning at 6 am it stood at 169,000, at 9 am at 172,384 and by 5 pm it reached 185,000 “views.”
A huge thank you to all of you who put the link http://articles.mercola.com/sites/articles/archive/2010/07/03/paul-connett-interview.aspx on your Facebook page or your website and encouraged others to do the same. Are there any other places you can get this link posted?
The introduction of Mercola’s commentary has been translated into Italian and posted on a Zero Waste website out of Sicily – http://rifiutizerotrapani.blogspot.com/2010/07/case-agaist-fluoride-video-intervista.html !
Please maintain the momentum and help this go viral. Going “viral” means that enough new people pass this along so that it gains its own momentum without being pushed from the organizers. One simple way you can help do this is to put this PS on ALL your email messages for the next few days: “PS: Please watch this important video” and give the link.
As a result of the Mercola-Connett interview we have added 135 new names to the Professionals’ Statement calling for an end to fluoridation worldwide. Our current total is 2,944 and we are edging closer and closer to a total of 3000 signers.  Professionals can sign the statement at http://fluoridealert.org/statement.august.2007.html
The point people for the effort to get fluoridation out of Ontario had this to say about the response.
Welcome To GASLAND
About the film
“The largest domestic natural gas drilling boom in history has swept across the United States. The Halliburton-developed drilling technology of “fracking” or hydraulic fracturing has unlocked a “Saudia Arabia of natural gas” just beneath us. But is fracking safe? When filmmaker Josh Fox is asked to lease his land for drilling, he embarks on a cross-country odyssey uncovering a trail of secrets, lies and contamination. A recently drilled nearby Pennsylvania town reports that residents are able to light their drinking water on fire. This is just one of the many absurd and astonishing revelations of a new country called GASLAND. Part verite travelogue, part expose, part mystery, part bluegrass banjo meltdown, part showdown.”
“Senator Lois Wolk (D-Davis), who cast the lone no vote against AB 2775, described the bill as “lipstick on a pig.” She voted against the amendment she believes it makes the bond more palatable. “This won’t eliminate the possibility of gaming the system,” she stated.”
No on Water Bond Coalition Blasts AB 2775
Senator Wolk describes bill as ‘lipstick on a pig’
_______________________________________
Representatives of the No on the Water Bond Coalition slammed AB 2775, an alleged “fix” of the Safe, Clean, and Reliable Drinking Water Supply Act of 2010, after the bill passed out of the Senate Natural Resources and Water Committee on June 22.
“AB 2775 is no fix at all,” said Tina Andolina of the Planning and Conservation League. “Tinkering around the edges won’t fix this bond.
This measure does not truly address the problem that the bond will allow private companies to profit as taxpayers foot the bill. We will see water privatization on an even larger scale if the bond passes, and this bill does nothing to address the problem.” More
Political Mischaracterization of Fluoridation Opposition Dismays Scientists
CANTON, N.Y., June 22 /PRNewswire-USNewswire/ — Scientists representing the Fluoride Action Network (FAN) strongly object to recent mischaracterizations of fluoridation opponents by political pundits Rachel Maddow, Keith Olbermann and others in conjunction with Senator Harry Reid’s Nevada re-election campaign.
“Fluoridation opposition is science-based and growing,” says Paul Connett, PhD, FAN Executive Director, who has co-authored the upcoming book, “The Case Against Fluoride: How Hazardous Waste Ended Up in Our Drinking Water and the Bad Science and Powerful Politics that Keep it There.” Co-authors are James Beck, MD, PhD, professor emeritus of medical physics at the University of Alberta in Calgary; and Spedding Micklem, DPhil, professor emeritus at Edinburgh University.
“We have spent many years investigating water fluoridation and the toxicity of fluoride and we are dismayed that commentators are willing to repeat, without verification, pro-fluoridation statements that disparage scientists and citizens who oppose the practice,” says Connett.
“FAN’s website http://www.FluorideAlert.org  has a wealth of scientific information indicating that water fluoridation is neither safe nor effective,” says Connett.  “In fact, mounting evidence shows that it is harmful to large segments of the population and has helped to create an epidemic of dental fluorosis in children.”  On April 12, 2010, Time magazine listed fluoride as one of the “Top Ten Common Household Toxins” and described fluoride as both “neurotoxic and potentially tumorigenic if swallowed.”
