I am here today to read this into the record……

CPUC officials have violated their Oath of Office, endangered public health and violated federal wiretapping laws by failing to protect the public from Smart Meters.  Therefore, the CPUC is vulnerable to a lawsuit.  The individual Commissioners of the CPUC and Judge Wong may be held personally accountable in a lawsuit for damages caused by Smart Meters.

A formal notice of liability to the California Public Utility Commission (CPUC) about the dangers of Smart Meters was delivered verbally with a hard copy that was handed to Judge Wong during a public hearing.  The notice of liability was entered into the public record by a court reporter on October 24, 2011.

Government officials, under the “qualified immunity” law, may be held personally liable for damages because their immunity is valid only “insofar as their conduct does not violate clearly established statutory or constitutional rights of which a reasonable person would have known”.  The CPUC should be aware that Smart Meters violate federal laws and the California Constitution because they took an Oath of Office.
