Who owns genes?

First we heard a clip from Elizabeth Sariani. She’s a breast cancer survivor who might be at an elevated risk for ovarian cancer. She could find out for sure by getting a test that would tell her if she has a mutation on either of two genes – the BRCA 1 or the BRCA 2. Until recently, a biotechnology company called Myriad had total control of the patents for those two genes as well as the legal rights to the testing service used to find mutations on them. That meant that anyone who wanted to find out if they had the mutation had to go through Myriad but Elizabeth Sariani says she couldn’t afford to pay what Myriad was asking.

Last week, a judge in the United States ruled that Myriad’s patents on the BRCA 1 and BRCA 2 genes are invalid. The decision could set a historic precedent and it has already thrown into question the validity of the patents on about 2,000 other human genes. Myriad is planning to appeal the decision.

The case was brought by a group of patients including Elizabeth Sariani, as well as a group of scientists. They were represented by the American Civil Liberties Union and the Public Patent Foundation. Sandra Park was one of the attorneys on the case. She’s a staff attorney at the ACLU’s Women’s Rights Project and she was in New York City.

We requested an interview with a representative from Myriad Genetics but they declined to speak to us, because of the pending appeal.

The Biotechnology Industry Organization is supporting Myriad in this case. Hans Sauer is the organization’s Deputy General Counsel for Intellectual Property. He was in Washington.

For a sense of how this American lawsuit might affect Canada, we were joined by Tim Caulfield. He’s the Canada Research Chair in Health Law and Policy at the University of Alberta. He was in Edmonton.


Arizona concealed weapons bill expected to become law

Within the next week, Arizona could become the first state with a large urban population to allow U.S. citizens to carry a concealed firearm without a permit throughout the state of Arizona. Only Alaska and Vermont have similar laws.

The Arizona House voted Thursday to make the state the third in the nation to allow people to carry concealed weapons without a permit, sending the governor a bill that would allow Arizonans to forego background checks and classes that are now required.

Currently, in Arizona carrying a hidden firearm without a permit is a misdemeanor punishable by up to six months in jail and a fine of up to $2,500.

Senate Bill 1108, crafted by Sen. Russell Pearce, R-Mesa, passed in the House of Representatives on Thursday with a vote of 36-19 and no comments from either side.

“This is a big day,” National Rifle Association lobbyist Matt Dogali said. “This is a major restoration of a principal right.” More

My friend and neighbor wants to promote a “Congressional Reform Act of 2010”. It would contain eight provisions, all of which would probably be strongly endorsed by those who drafted the Constitution and the Bill of Rights.

I know many of you will say, “this is impossible”.  Let me remind you, Congress has the lowest approval of any entity in Government, now is the time when Americans will join together to reform Congress – the entity that represents us. We need to get a Senator to introduce this bill in the US Senate and a Representative to introduce a similar bill in the US House.  These people will become American hero’s..

We have a one political party system in America: The republican faction of that single party likes war, torture, huge deficits, and stealing our freedoms; the democratic faction likes continuing wars and torture, instituting more welfare, higher taxes, eliminating small businesses and family farms, while stealing more of our liberties than the republican branch of that party does. 

Let’s call this one party the “Plutocrats,” because the Demo/Republican platforms follow the agenda of the super rich plutocrats, the ones the democratic branch pretends to hate. 

The Plutocratic Political Party (PPP) is owned and funded by the International Monetary/Banking Cartel, a tightly-knit group of private fascists, who are trying to bring about a One-World government, they would own and control, as they currently own and control the US government. 

In such a One-World government, these private money-men will be given all the world’s created and natural wealth and resources, as payment for the debts incurred by the One-World government, on money these international bankers created on their computers. This Banking Cartel, with the power of governmental guns, and intelligence “services” who control those guns, plan on owning the world. The Cartel’s Nazis, of World War II were merely a dry-run for the coming real thing. 

Wow … what a deal … owning the whole world with simply some strokes on their computers, and by controlling some psychopathic intelligence agents. And all orchestrated by a handful of super-rich fascists, with a little help from legions of sociopathic bureaucrats, politicians, corporate executives, media hacks, professors, and more psychopaths from intelligence agencies.  More

Derivatives, those obscure financial products built off the value of other assets, have their historical roots in agriculture. Farmers and investors would place bets against the harvest as a way to hedge against the uncertainty involved in making your living off of raising food. The derivatives market is now a several hundred trillion dollar, highly complex financial market, but the congressional agricultural committees still hold legacy jurisdiction over regulating it.

TNR’s Noam Scheiber has a great piece on the state of financial reform in the Senate, describing an emerging strategy to put some relatively strong consumer protections in the bill while giving Wall Street much of what they want in areas that the public isn’t paying attention to. Derivatives reform — or the lack therof — is likely going to be the area where Wall Street gets their biggest win, and the Senate Agriculture Committee is set up to be the driving forces behind delivering it.
