MEMORANDUM OF LAW ON THE NAME

17.  The Birth Certificate

Since the early 1960’s, State governments – themselves specially created, juristic, corporate persons signified by all caps – have issued Birth Certificates to “persons” with legal fiction all-caps names. This is not a lawful record of your physical birth, but rather the birth of the juristic, all-caps name. It may appear to be your true name, but since no proper name is ever written in all caps (either lawfully or grammatically) it does not identify who you are. The Birth Certificate is the government’s self-created document of title for its new “property,” i.e. the deed to the juristic-name artificial person whose all-caps name “mirrors” your true name. The Birth Certificate brings the new all-caps name into colorable admiralty/maritime law, the same way a ship (and ship of state) is berthed.

One important area to address, before going any further, is the governmental use of older data storage from the late 1950’s until the early 1980’s. As a “left over” from various teletype-oriented systems, many government data storage methods used all caps for proper names. The IRS was supposedly still complaining about some of their antiquated storage systems as recent as the early 1980’s. At first, this may have been a necessity of the technology at the time, not a deliberate act.  Perhaps, when this technology was first being used and implemented into the mainstream of communications, some legal experts saw it as a perfect tool for their perfidious intentions. What better excuse could there be?

However, since local, State, and Federal offices primarily used typewriters during that same time period, and Birth Certificates and other important documents, such as driver’s licenses, were produced with typewriters, it’s very doubtful that this poses much of an excuse to explain all-caps usage for proper names. The only reasonable usage of the older databank all-caps storage systems would have been for addressing envelopes or certain forms in bulk, including payment checks, which the governments did frequently.

Automated computer systems, with daisy-wheel and pin printers used prevalently in the early 1980’s, emulated the IBM electric typewriter Courier or Helvetica fonts in both upper and lower case letters. Shortly thereafter, the introduction of laser and ink-jet printers with multiple fonts became the standard. For the past fifteen years, there is no excuse that the government computers will not accommodate the use of lower case letters unless the older data is still stored in its original form, i.e. all caps, and has not been translated due to the costs of re-entry. But this does not excuse the entry of new data, only “legacy” data. In fact, on many government forms today, proper names are in all caps while other areas of the same computer produced document are in both upper and lower case. One can only conclude that now, more than ever, the use of all caps in substitution the writing a proper name is no mistake.

When a child is born, the hospital sends the original, not a copy, of the record of live birth to the “State Bureau of Vital Statistics,” sometimes called the “Department of Health and Rehabilitative Services” (HRS). Each STATE is required to supply the UNITED STATES with birth, death, and health statistics. The STATE agency that receives the original record of live birth keeps it and then issues a Birth Certificate in the corrupted, all-caps version of the baby’s true name, i.e. JAMES WILBER SMITH.

cer-tif-i-cate, noun. Middle English certificate, from Middle French, from Medieval Latin ceruficatum. from Late Latin, neuter of certificatus, past participle of certificare, to certify, 15th century. 3: a document evidencing ownership or debt. [Merriam Webster Dictionary (1998)]

The Birth Certificate issued by the State is then registered with the U.S. Department of Commerce — the Executive Office — specifically through their own sub-agency, the U.S. Census Bureau, which is responsible to register vital statistics from all the States. The word “registered,” as it is used within commercial or legal based equity law, does not mean that the all-caps name was merely noted in a book for reference purposes. When a Birth Certificate is registered with the U.S. Department of Commerce, it means that the all-caps legal person named thereon has become a surety or guarantor, a condition and obligation that is automatically and unwittingly assumed unless you rebut the presumption by effectively noticing them: “It ain’t me.”

Another meta-analysis of Chinese studies showing a possible relationship between fluoride exposure and lowered IQ has just been published. This study by Liu and Cian of the Department of Health Statistics, China Medical University, in Shenyang, China was published in Chinese (see the English abstract below).

The authors reviewed 13 individual studies and found that their statistical analysis suggested “a negative correlation between high fluorosis exposure and children’s intelligence development” and concluded that “Exposure to high levels of fluoride may adversely influence children’s intelligence development.”

FAN will be using some of the money we are raising right now to have this translated, along with the other 5 Chinese IQ studies which are still only available in Chinese.

This study by Liu ad Cian comes on the heels of the study by Tang et al. (2008) published in August and an analysis by Connett, M and Limeback, H, presented at the IADR conference in Toronto, in July.  All three reviews have yielded similar conclusions.

Links to all 23 individual studies (from India, Iran, Mexico and China) which report an association between fluoride exposure and lowered IQ in children is at……

Oklahoma still fighting for Sovereignty

For Immediate Release
12/23/08
Citizens to Assemble in Support of Bipartisan Legislative Efforts to Protect Oklahomans from the Federal Collection, Sharing and Control of Personal Data.
Oklahoma City–January 3rd there will be “Citizens Assembly for Oklahoma Sovereignty” sponsored by OK-SAFE, R3PUBLICANS, and the Constitutional Alliance along to support the Tenth Amendment Resolution and to show that Oklahoma citizens firmly reject The Real ID Act of 2005 and similar proposals to use personal information or biometrics to enroll Americans in a national identification plan. This bipartisan event is open to all residents of Oklahoma who wish to retain their rights and freedoms as guaranteed by the US Constitution and Bill of Rights should attend this assembly on Jan 3rd at 7 pm to be held at Character First, 520 W. Main in OKC.
State Representative Charles Key and Senator Constance Johnson will be special guest speakers at the assembly and will inform attendees about current proposals before the State Legislature that would protect Oklahoma citizens’ private data from being exposed.  Several Bills have been submitted by Oklahoma legislators that specifically address the collection, sharing and retention of personal information and biometrics that put all Americans at risk such as the REAL ID ACT.

The Tenth Amendment Resolution HJR 1003, authored by Representative Key, presents fair notice to Washington that Oklahoma will not be intimidated into relinquishing legal authority, responsibility or jurisdiction over matters reserved to the state as declared Tenth Amendment to the US Constitution which reserves all powers not granted to the federal government to the state or the people.

Mark Lerner, leading expert on the biometrics industry, founding member of the Constitutional Alliance will be present to give an update on the latest news regarding parallel efforts to resist untenable national/global ID schemes.  The Constitutional Alliance is a non-partisan coalition of Americans committed to preserving state and national sovereignty and the unalienable rights to life, liberty, and property. They have been working with legislators, officials and citizens nationwide to educate them about the grave threat posed to our fundamental freedoms that the misuse of biometric identifiers pose and have crafted model legislation designed to stop the national/global ID plan.

The government take over of the US economy …BRASSCHECK TV/video

Where all the money goes.  Two sets of books

The government take over of the US economy

This video was originally produced on January 8, 2000 by Walter Burien.

The government, at all levels, is running a very simple financial con game.

If something produces revenue – like bridges, highways, ports, or successful investments etc – that revenue goes into off budget slush funds.

If it costs money, it’s charged to the public via taxes.

This is being done at all levels of government – including state, county, city, and school districts.

The total “off budget” funds held by the various governments amount to trillions of dollars.

The real accounting is contained in what’s called Comprehensive Annual Financial Reports (CAFR) which are not only not made available to the public, their very existence is never mentioned by the news media.

Why?

Trillions of dollars pays for a lot of corruption.

Every time an elected official stands before you and tells you the government is out of money and they have to raise taxes, he or she is lying through their teeth

Bush pardons drug dealers and crooks….but not Ramos and Compean

Bush springs drug dealers, leaves border agents to rot
Ramos-Compean supporter asks: ‘Why is the president dug in so deep?’

President Bush today added a convicted methamphetamine dealer, a cocaine distributor and two marijuana suppliers to the list of drug operators he’s pardoned while in office, bringing his total of drug suppliers who have been pardoned or had their sentences commuted to 36.

He’s also pardoned more than a dozen thieves, seven embezzlers, an arsonist, several mail thieves, a man who violated the Neutrality Act and eight Thanksgiving turkeys, but there’s been no clemency for U.S. Border Patrol agents Ignacio Ramos and Jose Compean, who were convicted of shooting at a fleeing drug smuggler.

Andy Ramirez of Friends of the Border Patrol, who long has been involved in the Ramos-Compean case, said the questions just start piling up.

“First and foremost is the question that has to be asked, ‘Why is the president dug in so deep’ on Ramos and Compean?” Ramirez said. “Look at how many members of Congress have sent him letters, and have held hearings.

“You really have got to start to wonder … does this doper (in the Ramos-Compean case) lead to somebody really big?” he said.

Joe Loya, the father-in-law of Ramos, said he, his daughter and grandchildren were “devastated” by word that Ramos and Compean had been denied clemency on the latest list of presidential actions.

“We were praying for a miracle. We just don’t understand where the connection is when drug smugglers are getting pardons and commuted sentences, yet two agents who are not criminals, who were just doing their jobs, are in isolation,” he told WND by telephone as he traveled to visit his son-in-law in jail on Christmas Eve.

George Bush could redeem himself,” he continued. “Ninety-five percent of our support is coming from Republicans. He certainly has nothing to lose.

“He could make millions of people feel good about it, or he could make one person (prosecutor) ,” Loya said. “We hope he will do the right thing.”

Bush today released a list of 19 more pardons or commutations. Included was a commutation of the life prison term for Reed Raymond Prior of Iowa, convicted of dealing methamphetamine. Pardons were handed out to William Alvis III of Ohio for cocaine distribution, Steve Doyle Cavender of Florida and Marie Elena Eppens of Washington for distributing marijuana.

Prior had admitted having methamphetamine with plans to distribute it following three prior felony drug convictions. Bush has approved 10 commutations and about 200 pardons in his two terms, about half the number granted by Bill Clinton.

Ramos and Compean, meanwhile, are serving 11- and 12-year prison sentences, respectively, for shooting an illegal alien drug dealer while he smuggled nearly 750 pounds of marijuana across the border. They were convicted of assault, discharge of a weapon in the commission of a crime of violence and deprivation of civil rights.

Send a FedEx letter to the president asking him to help Ramos and Compean.

And sign WND’s petition urging President Bush to free U.S. Border Patrol Agents Ignacio Ramos and Jose Compean.

U.S. Attorney Johnny Sutton’s office gave the smuggler, Osbaldo Aldrete-Davila, full immunity from prosecution for agreeing to serve as the government’s star witness and testify against the border agents. A ruling, from the 5th U.S. Circuit Court of appeals, affirmed all convictions except for tampering with an official proceeding, which it vacated and remanded for resentencing.

While Aldrete-Davila was waiting to testify against the agents, he also was involved in another drug smuggling case, but that information was withheld from jurors in the Ramos-Compean trial.

Eventually, the smuggler was sentenced for the second case, but his sentence was considerably shorter than that of the agents who tried to halt his activities in the earlier episode.

Ramos’ attorney, David Botsworth, said a petition for writ of certiorari was filed with the U.S. Supreme Court and docketed Dec. 11. The government has the right to file a response should it choose to do so by early January.

“It’s obviously an astronomical uphill battle to get review in the Supreme Court,” Botsworth said. “I think the issues are worthy of their consideration.”

Send a FedEx letter to the president asking him to help Ramos and Compean.

And sign WND’s petition urging President Bush to free U.S. Border Patrol Agents Ignacio Ramos and Jose Compean.
