American hospitals have devised a scheme to guarantee they never get stuck with an unpaid bill. It’s called guardianship.
Thinking of checking into a hospital? Think again. You may never see home again.
- Ginger Franklin, Hendersonville, Tennessee, fell down the stairs in her condo and suffered a bump on her head. She was declared “temporarily mentally incapacitated” and a guardian was appointed through the courts. Within six weeks, the guardian had soldFranklin’s home, car, furniture, and drained her bank account. Today,Franklin has her freedom back, but she is having to start all over.
- Michael Kidd, 72, of Richardson, Texas, fell in his yard and broke a hip. Now, he is living in Countryside Nursing Home with his wife. Both were removed from their home when the state of Texas petitioned the courts claiming that the Kidds were mentally incompetent. Their house sits vacant and neglected, with rotting food still remaining in the refrigerator. The Kidds have been confined to a single room in the nursing home, while the state appointed guardian burns through their money an gives them a mere $60 a month spending allowance which they have been using to buy “real” food.
- Robert Milton (not his real name) was taken to the hospital because he fell “one time too many” at his home, and although his stepson had been given power of attorney to make all of his health care decisions, a court-appointed corporate guardian placed Milton against his will in a nursing home where he is now isolated from his family and friends. Meanwhile, his money is being spent as quickly as possible by the Orlando-based guardian and her attorneys.
How It Commences
Joseph Niedesky (not his real name) was air lifted to a hospital in Orlando from Ocalaby helicopter after he was the victim of a motorcycle crash. But something went terribly wrong during Niedesky’s surgery and he aspirated on his own vomit, causing some brain injury. That’s when a corporate guardian was contacted by the hospital and appointed by the court as Niedesky’s full plenary, permanent guardian.
What Happens Next
The corporate guardian who petitioned the court stated in the court papers that Niedesky had no family. In reality, Niedesky had been married for more than 20 years and had four teenage children. It took more than two months for Niedesky’s wife to discover what had happened to her husband and where he was located.
The Family is Always Portrayed as the “Devil Incarnate”
What happened to Niedesky is becoming a commonplace occurrence in America. A family member is rushed to the hospital. Surgery occurs and something sometimes goes terribly wrong. However, by quickly petitioning the courts for guardianship, the hospital avoids any kind of lawsuit for negligence or wrongful death. Niedesky’s wife wanted to bring him home and get him out of the guardianship. The guardian, however, kept moving Niedesky from location to location, city to city, until the statute of limitations for suing the hospital had expired. Shortly after the statute of limitations ended, Niedsky just happened to die.
“The hospital saved itself millions in a lawsuit. It is typical that shortly after the statute of limitations runs out, the ward just happens to suddenly die,” stated David Newman, Gainesville, Florida, a civil rights guardianship reform advocate.
Niedesky’s wife was portrayed in the court record as uncaring, incompetent, over-meddling, and negligent, and although these descriptors seem to be a contraction of terms, you will typically find the most cynical descriptions of family members in most court files where an involuntary guardianship has been granted by the courts to a total stranger.
For example, in Milton’s case, Milton’s stepson had been named long ago as his power of attorney and health care surrogate. That designation, however, was destroyed by the court and the corporate guardian even accused the stepson of stealing several thousands over the years from his stepfather. Today, Milton’s stepson, a 65 year old retired veteran, finds himself in a legal nightmare gathering bank records and hiring attorneys and forensic accountants to prove his innocence. Meanwhile, the corporate guardian is spending Milton’s money like water.
The Other Scenario
Tom Griffith (not his real name) wonders why an Orlando-based corporate guardian would be interested in his father at all.
“He has no money. All he gets is a small monthly cheque from Social Security of about $800.00.”
I explained to Griffith that his father has been marked for destruction and will mostly likely not be among the living in a very short period of time. “We live in a country that is ruled by corporations, not the U.S. Constitution. If there is not enough money for the nursing home to cover its expenses, there is ‘no reason’ to keep your father alive.” I explained to Milton how Thomas Chada’s father was sent to him as a box of ashes and how other wards seem to always turn up “expired” shortly after a corporate guardian and her attorneys have burned through all of an elderly person’s money.
But in this case, Griffith said there was no reason to destroy his father. “There is no money to gain.”
“Yes, but that is the point. The corporate guardians have a symbiotic relationship with the nursing homes. Sometimes, the nursing home gives them a wealthy resident that they can bilk. At other times, the corporate guardian does them a favor by making premature end-of-life decisions when there is not enough finances to cover the elderly person’s day-to-day expenses.”
In the case of Griffith’s father, who just received quadruple open heart bypass surgery, it was determined that the ward, age 74, now needed dialysis, a very costly ongoing treatment.
“The doctors said my father does not want dialysis,”Milton stated. “But I know my father wishes to live; he is only 74.”
“They probably got your father to sign such a statement without him even knowing what he was signing,” I explained.
Milton wanted to know what he could do to rescue his father out of this dangerous and life-threatening situation.
“You can hire an attorney, but you might end up spending more than $500,000.00 of your own money to become your father’s guardian.”
“I don’t have that kind of money,”Griffithdeclared, shocked.
It was obvious that the scenario I was describing was greatly upsetting Griffith. Those of us who have already lived this scenario remember going through the predictable stage of “mental shock” followed by the overwhelming urge to seek justice—at any cost. I explained to Griffith that he may find himself bankrupt as a result of trying to help his father out of this doomed guardianship situation.
My phone continues to ring as victims, desperate to find a solution, want to know what they can do.
In a country that is ruled by corporations and corporate greed, there will be no solution to The Guardianship Nightmare until a public uprising is so severe that these kinds of abominable– yet commonplace situations– will no longer be able to occur.

MiddleChild from Australia- I too have had a fair bit to do with the Guardianship board- 4 times in NSW.
3 times, no one in the family wanted to step up and make the decisions; even though some lived nearby.
The last time, the person had suffered dementia in his 80′s and had no family that could be found(he had immigrated from Germany in the 50′s, and had changed his name.)
In all 4, Public guardianship was the best option. I am sure abuses do occur, ha!- probably at a similar rate to when a family member obtains guardianship, but I have never come across any in 10 years working with elderly folk in a medical setting.

Rely to DC – My husband also ahd his arms tied to the bed for five weeks because he wanted all the “research” medications stopped – he had no hope of survival – it was a nightmare. It is actually getting scary to live in this country. Every institution is out of control. It’s like we’re the new Nazis and our government/businesses are finding more unique ways to brutalize and disenfranchise people. Sometimes I find myself worrying about the future.
sounds like a real nightmare scenario, when the hospitals became prisons, and doctors are executioners. The only question left is what exactly was the crime of their poor victims? My mother’s hands were tied up with a piece of rope while she was on the icu, because the doctors kept force pumping countless medications up her veins, that she was at one time trying to yank all the medicine tubes out of her veins, it was at that point when the hospital tied up both of her hands with a piece of rope. The doctors murdered my mother less then two weeks later, despite my many protests, they gave her four units of expired rh positive blood, even though she was rh negative, and even though I was donating blood for her at the hospital that was her exact same blood type.
the doctors stole two units of my own rh negative blood that I had donated for my mother, and gave her four units of expired rh positive blood instead. I have been trying to sue them, but a lot of attorneys don’t want to sue doctors and hospitals.
the whole story gets a whole lot more sordid then this. Later I found out that the hospitals and doctors are selling rh negative blood to the pharmaceutical companies for as much as 50 thousand dollars per unit! Rh negative blood has became very valuable to doctors and hospitals because the pharmaceutical companies are using rh negative blood as the key ingredient to make drugs for hiv patients to help them fight deadly infections.
these drugs do not save their lives, but they prolong the lives of hiv patients for about 2 or 3 years.
not only did the hospital made huge profits out of my mother’s illness by murdering her, they also made huge profits out of me by selling my blood that they obtained under false pretenses, because i had donated my blood for my mother;s own use, which she badly needed it.
Because of the fact that my mother’s blood type was very rare, I was afraid that the hospital may not have it on hand, and so I volunteered to donate blood for my mother.
The doctors had given me their written consent for this, and yet they went ahead and denied my mother my blood, and then gave her four units of expired rh positive blood which killed her.
but, they kept my blood! No doubt they sold it to the pharmaceutical companies for a tidy profit. the lesson that I learned from this is most doctors are mass murderers and they are also thieves.
At one point I was forced to quit donating blood for my mother because the hospital kept stealing my blood and not giving it to her. And I realized that not only were they murdering my mother, they were going to murder me too, if I let them. So, I was forced to quit donating blood for my mother all together.

Know that the hospitals/doctors can *code* you anytime they want to -code meaning ‘stopping your heart from beating, requiring resuscitation efforts to survive-hence the DNR- do not resuscitate orders that they push on everyone with their media hype and horrid reality tales a la Terry Schiavo…
Do not ever have a DNR for them to take advantage of-not that they need that order to off you. Quite capable of administering enough morphine while you or a loved one is on a vent to shut your systems down.
God help you if you have anything anyone wants to steal before, during or after your miserable death at the hands of the medical system. POAs, living wills all be damned and ignored or other newer models done while the patient literally doesn’t know what they are doing or won’t remember having done once recovered from their traumatic reasons for being in the hospital to begin with.
If you enjoy living your life-be extremely wary of using any self insuring hospital… like Kaiser… they bonus for ‘keeping their healthcare costs down’… experienced the ways they do that with my own husband.
I have still yet to see the POA my husband’s daughter supposedly had as she ‘chose for my husband to do only palliative care’ allowing him to die with every medical person involved in his death refusing to talk with me, his wife.
Marriage, laws, paper work will NOT protect you if there is money to be made off of either your captive life or death.
And if this happens to your spouse, watch how fast the banks will allow the theft of your marital assets, the hospital allow the theft of your husband’s body, the law enforcement allow the theft of vehicles and other property, the lawyers allowing fraudulent storage bills for property stolen submitted to ‘the most corrupt court of all PROBATE COURT’-the stunned widow/family getting bids from lawyers who won’t really do anything to help you at all ranging from $10,000 to $45,000 to recover your own stolen property that unrecovered-results in the murdered one’s family going bankrupt and home auctioned off.
The lights are shining on these devious actions and non actions performed by many different systems in this country-all the ones involved make HUGE MONEY doing this-doctors, lawyers, hospitals, courts, all the taxpaid public employees making sure these crimes do not get investigated, these crimes do not get prosecuted-will make damn sure that nothing is done that prevents them from having literal life and death CONTROL OVER PEOPLE and stealing thousands to millions of dollars.
They aren’t going to give this one up people. And for those who scoff at the notion of it ever happening to them because ‘they’ve got their living wills, their trusts, their POAs, etc’… if you’ve got anything anyone wants to steal or your chronic condition and you or your body’s inability to die in a timely manner costs those people their BONUSES… guess what? YOU LOSE.
Thanks for this article. Even in our own families I’ve seen how people are taken over by the system. In this case it’s in Massachuesetts. Be aware everyone of what is happening. I place the blame on the legal system, lawyers and judges. This is what I’ve witnessed:
A man (a WWII combat pilot) who worked his whole life and built up a nest egg and when he passed away, his wife was left very well taken care of, with insurance and assets, and a will guiding the wise distribution of those policies and assets to the children when his wife passed away which happened 24 years later. One child of evil intent connived the wif/mothere in her twilight years to signing over her will. A lawyer did this and the duped wife agreed. The new will stipulated that the wife could stay in her home UNLESS she was deemed mentally unfit. So the evil child waited 7 years and then went to many doctors trying to get her mother committed and finally found a crackpot doctor to agree and the mother in her 80′s was put into a mental ward where she didn’t stay long as the doctors didn’t see a problem. But, the damage was done!!!
Once your found “insane” by the system, your forever more “insane”. So she whittled away, did not get walked in the subsequent nursing home, and lost the ability to walk, then eventually died long before her time. Her other good children were disabled by the legal system from caring for their mother the way she should have been cared for and as directed by her husbands will.
The lawyer for the evil child got her chunk of money I’m sure but the state makes it impossible to get an accounting of what happened to all the money.
The state of MA makes it so no inquiries cannot be made into an accounting of where all the 100′s of thousands of dollars went. Lawyers and judges Rob and enable robbing people of their lives and assets. The state of MA enables the destroying of people and families for money.

Hello Bill,
You missed the point of the article completely. These hospitals are going through channels to get paid, even when I’m sure that they have “Phone Numbers of Nearest Kin” on File. I know my hospital made sure that they had mine. And wouldn’t even admit me without it on file. They got the court to “name” a person probably at the hospital to “care” for your/their assets. Selling your/their home, your/their assets to pay the bills. When you recovered from your illness you would end up homeless. Sorry, I don’t care that we are living longer. You don’t steal from people. And that is what these hospitals are doing.
If you don’t see anything wrong with that…Sell your house and give the money to the poor or the hospital and live on the streets.

Thanks for the article, it pissed me off, but i really shouldnt be too surprised!! If you know where your relative is then its time to kidnap them out i guess, but that just seems like stupid kid talk. How does one really get out of that mess?? Solutions people, solutions, i have none, as this is the first i have heard of this and it makes me angry.
Incorporate and place your assets in a trust. They can’t be seized, and a court appointed guardian will have no access to them.
Roam the halls on the ward find a janitor or laundry cart pusher or orderly. Or ask the orderly or janitor his ideas for escape. Tell them what’s in it for them if they successfully carry it off. Like a hundred dollar bill at the end of the successful caper.
Always go to the hospital with some cash stash to bribe your way around and your way out.
What’s is your most valuable possession? Diamonds? Gold? Silver?
No…believe me, it’s your signature. With your signature, you give consent, enter into contracts and waive your rights..
Every time you sign anything, sign “without prejudice” above or below your name. That means everything!!! Especially any government form, traffic ticket, court document, Driver License, insurance policy and in this case, hospital entrance form.
Signing “without prejudice” informs the other party that you are reserving all your rights. They may still try to take advantage of you but at least you have some legal recourse later and can hold the other party accountable..
Blindly signing documents without reading and/or understanding the language is how these things happen.

But the time tested method is to sneak into the doctors lounge and grab a white coat and ID badge. Then join with the interns making rounds, blend in by making profound opinions of the various patients conditions then at lunch time ask them for a ride to a sandwich shop and make your getaway. You can perhaps enjoy a quick meal with your new found friends and stick them with the restaurant bill.

I am not quick to blame the attorneys in this case. The insurers are the demon here and they are using lawsuits as a red herring. I could have used an attorney during the three years I battled BCBS. Mine was not such a huge deal but was very stressful. Imagine folks that have been disabled and now have to deal with expenses that are unpaid.

Blue Cross Blue Shield of -New Jersey- is a MAFIA organization. Yes I said it , they should be investigated under RICO act.
My son had an accident in 2003 and BCBS could never find their way to pay the bills. Each bill was rejected for some deficiency. They would not accept a fax of any document and would not return calls nor follow through on any promised resolution. Everything I mailed them (registered mail) was misplaced and not scanned into the “system”. They did not pay a $50K hospital bill for 1 year. I was called by the hospital to intervene. Checks that were sent were lump amounts which matched none of the statements. I hounded them for three years to resolve a $700 discrepancy. When they paid up, I later received a 1099 revealing that they paid me statutory interest (for the hospital bill) that I was due anyway and not the $700 they were also responsible for.

There is a great disparity between the actual costs of medical services and what is billed and what is settled by insurance companies. If you compare what is billed versus what is settled, one would have to ask themselves how the medical profession can continue to exist, yet it does. How so? On the backs of the uninsured who often are bankrupted.
If you have no insurance, you will pay about 3 times the amount an insurance company would settle with the provider. Recently my wife had a minor surgery and the difference was over 10 times.
A while back, I was at a doctors office on a followup. Knowing that my insured office visit was $125, I overheard the doctor instruct his receptionist to quote $450 to an uninsured patient who called.
I am not blaming the medical profession, rather the insurance companies who have inserted themselves into the middle of what should be a fair market business transaction. The insurance companies have positioned themselves to control every aspect of health care and are ripping off the doctors and the patients.
For those who denigrate attempts to provide single payer insurance I urge you to look at the whole picture and imagine ways the system can be revamped. I will suggest that the insurance companies have to be the first to go away..
Its a shame that such a great article is so completely misunderstood by so many. It’s not simply runaway capitalism or a corrupt monetary or banking system that is responsible for these inhumane actions (‘although they are prime contributors for sure) …it’s the massive sociological advancement of an unprepared culture that has led to this. We as a free people have become so wealthy and so “entitled,” so rapidly that we can demand the very best and most costly of everything…especially when it comes to health care..without any regard for the cost, consequences or concern for future ramifications.
Stop and consider who it was who created these emotionless money-gluttons (the hospitals). It was the very people whom are now being held hostage and summarily exterminated when their, and their relatives’, money and vivacity run out.
Old people didn’t build the hospital that keep them alive into the 80′s and 90′s and beyond: young people did that. And because they could, they build those hospitals with the most elaborate and expensive equipment in the world.
Sometime when you care to take the time, check on the costs of a PET Scan, CAT Scan, MRI unit, a heart-lung machine. Ck on the cost of the hyperbaric Chamber in the burn unit. Better yet, check on the costs of the mammoth particle accelerator now being used in Cancer therapy (one hundred Million dollars each!).
Are these machines being built to save lives? No! They’re being built because, through Medicare and other health financiers, there are billions to be made in owning one. Reimbursement from Medicare and others can be up to 50% higher than using other treatments, even thought there is absolutely no proof that the particle accelerator can provides a single benefit over existing treatment modalities.
Long life-spans are wonderful if your can afford them (and need them) and if they are productive and tolerable. But when those very lives are not productive (or even enjoyable, and so often agonizingly painful), why do we spend so much money on them that hospitals have to blackmail the relatives of the aged and afflicted in order to pay for what those same pour souls insisted (societally) on having at their disposal in their waning years.
Want a solution to these and all other monetary problems of the country (it’ll seem unrelated at first)? A solution to the health care problems” To the banking and mortgage industry problems, and to the economy as a whole?
It’s ONE THING (‘thank you. Jack Palance in City Slickers”): It is most certainly that we must, once and for all, force a countrywide “Loser Pays” legal system. Period!
It’s our wholly inane, arcane one-sided and impractical legal system that has allowed for the creation of all of our current woes (yes “ALL”). When we get to a point where people stop suing when they know with certainty that they’re wrong…its then that all of this elitist oligarchical crap goes away. I had a horrible experience my first and so far only time in an ER. If you don’t like a restaurant, you leave and go to another, but if you don’t like the hospital care you are receiving? Too bad.
The fact is that hospitals are run like prisons. You can leave only if you can afford to ‘make bail’. What I mean is that I complained to the hospital administration, and told them I wanted to leave and go to another hospital. They told me that I’m free to go at any time…but without an ‘official’ discharge, insurance won’t cover it, and I would be stuck with a $20,000 bill. Sound familiar? That $20,000 was my ‘bail’. So, I had no choice but to stay and endure, trapped there another night. The service didn’t get any better, as the next morning the doctor was supposed to come in at 5am and discharge me…but didn’t show up until around noon, leaving me there to stew for another 7 hours. No emergency. He just wanted to sleep in, I guess.
I had to pay $20,000 bail to get out of there, or wait for the ‘warden’ (doctor) to arrive the next morning. Tell me how this is any different than a prison? The high cost of health care basically turns all but the rich into ‘prisoners’.
You missed an important source of income for these folks. Do these guardians insure the lives of these folks? and if so, who is beneficiary. I say treat them the same way when they need help.
If one of my loved ones ever gets stuck in a situation like this, certain people would come up missing! Going through the courts is a fools errand. Most judges are vested in the private corporations that are the guardianship providers and also private corrections slave labor profits.

Over here in NSW Australia – we have a “Guardianship board” and they are known for stripping people of their assets but now thay are linked to the Public trustee a body which steps in if you haven’t got a will and as well touts for people to let them sort their wills out eg Power of attorney – they have caused shocking hardship and the ordinary people know nothing until they are hit hard by their stormtroopers
Thank you for writing about this very important issue which has been growing like a cancer in the medical industry! I can personally attest that it is not just the Elders of our communities who suffer at the less-than-caring hands of some institutions. Nor is it always the guardians who are the egregious party: following brain surgery in ’06, I was informed that I would not be allowed to leave Jackson Memorial hospital until they were satisfied that I was properly prepared for life in a wheelchair. Fair enough, it seemed then as if they were primarily concerned for my welfare.
However, after I’d demonstrated multiple times that I was prepared, and had the approval of physical therapists, nevertheless Administrators refused to discharge me. At the rate of thousands of dollars per day for ‘care’ I no longer needed. Even my Neurosurgeon was ready to discharge me! The day for my flight home to Alaska quickly approached with no resolution in sight.
Then I found out that Blue Cross/Shield Insurance was refusing to pay what they had previously agreed; that my Union was fighting on my behalf, and that the hospital would not discharge me until it was settled, stating that since I was from Alaska, they could not be certain of being paid. I was now a ‘medical hostage’, held against my will.
I was told that if I called a lawyer, the police, or attempted to discharge myself ADA, they would transfer me to the Psychiatric Ward. (talk about intimidation!) Lawsuits were threatened, the ACLU was called. Finally Blue Cross relented and paid ONLY for my hospital stay. Ultimately, I was discharged with only a few hours to catch my flight home, and they honestly did not care.
Yet it would be 4 full years of being hounded by Jackson Memorial hospital until Blue Cross fulfilled their obligations to me and IATSE Local 321 by paying the rest of the $250,000 bill.
Such treatment of human beings by an increasingly hostile Medical Industry must be stopped, and only from patients who have experienced this can we learn what is really happening behind the white walls of Institutional Care.

It’s about time someone mentions how corrupt hospitals. I caught the hospitals using medical alcohol and saying it’s drinking alcohol. They do this because you are not allowed to discharge medical bills even in bankruptcy if it was due to alcohol or drugs. policeabuse.weebly.com I was charged 30,000 dollars and they didnt even cast my arm.

We have a dishonest corrupt money system and all of our major societal institutions are equally corrupt.
We no longer have the rule of law in the U.S.A. and that is all we really ever had going for us.

Don’t agree? Then, honesty ask yourself these questions, “Am I better off than I was 10 years ago?” “Is the country better off than it was 20 years ago?” “Do my kids have a better future than I did, to look forward to?”
