House Committee Vote Soon On Corps, EPA and Wetlands Bill

Clean Water Restoration Act (CWRA) Is an Even Bigger Threat To You Than CARA

Congressman James Oberstar, Chairman of the House Transportation and Infrastructure Committee has said he is going to change the name of his proposed Clean Water Restoration Act (CWRA) to some other name.  This is a common tactic. 

They are getting so much opposition from you and others that they will change the name to confuse the voters (you).  You can continue to refer to it as the Clean Water Restoration Act and the Corps, EPA and Wetlands Land Grab. 

Let there be no mistake.  The House Transportation and Infrastructure Committee is going to vote on the Corps, EPA and Wetlands Land Grab Bill shortly, whatever they call it.  You need to call, fax and e-mail your personal Congressman plus the Congressmen on this Committee with your opposition to the bill.  You can call any Congressman at (202) 225-3121.

The bill has already passed the Senate Environment and Public Works Committee as S 787.  By looking at that bill, you can get an idea of how dangerous the House Bill will be.  You must also keep the pressure on the US Senate.

—–Below we will review background of the key issue points and give you the list of the Members of the Transportation and Infrastructure Committee that must be deluged with call, faxes and e-mails. 

—–No matter whether you are a rancher, farmer, business owner, landowner, miner, are involved in forestry, off highway vehicle use or any other use of private or Federal land, this bill will hurt you big time.  It is far cheaper to defeat it now in Congress than to have to hire lawyers and fight the Corps and EPA for the next 30 years. 

Please don’t sit back and say “I’ll let someone else do it.”  If you do your part, you will defeat this bill. If you fail to do your part, you could lose.  And the loss would be staggering. 

The green groups and some Members of Congress are pushing as hard as they can to have the Corps, EPA and Wetlands Land Grab bill take control of your water and land. The bill does not have a new bill number yet in the House yet.        

Action Items:

—–1.  Please forward this message to your e-mail list. 

—–2.  Call your own Congressman to ask him or her to get a copy of the draft bill from the Committee and send it to you.  That will make his staff aware you are concerned and keep them on their toes about the bill.    

—–3.  You should call, fax or e-mail the Congressmen on the Committee to ask for a copy of the Committee draft bill although it is probably not available.  That does not matter.  By just calling or sending your e-mail, you put them defensive.  Call any Congressman at (202) 225-3121. 

—–4.  One easy way you can really help is to call both your Senators at (202) 224-3121 to ask for a copy of S 787.  Ask for the staff person who handles the Corps and EPA.  Tell them you are opposed to what you have heard is in the bill.  That alerts them that you are concerned. That may keep them from supporting S 787 in a vote. 

—–5.  Fax or e-mail a one-page letter to your Congressman and both Senators opposing the Corps, EPA, Wetlands Land Grab bill in the House and Senate.  Mail is too slow. 

 —–6.  Call, fax and e-mail each Member of the House Transportation and Infrastructure Committee in opposition to the CWRA.  An updated Transportation Committee list is below.  They will vote on the Corps, EPA and Wetlands land grab soon.   

—–7.  Call your friends, neighbors and business associates to get them to call.  This is the biggest land grab since President Carter took hundreds of millions of acres in Alaska by designating them National Monuments in 1978.

Background:

—–The Democrats are moving to seize control of all U.S. waters.  The real goal of the Corps, EPA and Wetland Land Grab bill is to give the Corps and EPA control of all watersheds and all activities affecting all waters of the United States.  That means national land use controls.  It will give the Corps of Engineers and EPA control over all your property and water and any Federal land you use.      

—–Nobody wants to see the Corps or EPA in their backyard.  The Corps, EPA and Wetlands Land Grab Bill is the biggest threat to private property since CARA and actually affects far more land and people.  It seeks to overturn the Rapanos (2006) and SWANCC (2001) Supreme Court Decisions that said the Corps of Engineers and EPA could only regulate navigable waters.  If the bill passes, the Corps and EPA will control all waters, all wetlands and all watersheds in the U.S. 

—–Congress is considering in the Corps, EPA and Wetlands Land Grab Bill to expand the jurisdiction of the Clean Water Act, Corps of Engineers and EPA to include all “activities affecting these waters.”  In other words, the bill is a double whammy:  It expands the definition of waters and gives the Environmental Protection Agency (EPA), Corps of Engineers (Corps) and other Federal agencies control over activities that affect all waters — any land use activities. 

—–An example is that the Corps, EPA and Wetlands Land Grab will give Federal bureaucracies control over all the watersheds in the United States.  That includes dry land inside or adjacent to watersheds with water underground.  That means everything.  Because all land is in a watershed.

—–The Supreme Court said that when Congress passed the Clean Water Act in 1972 and limited Corps and EPA jurisdiction to “navigable waters” they meant navigable waters.  But Oberstar is trying to either get rid of the word “navigable” or gut it to give the Corps and EPA jurisdiction over ALL waters in the U.S.  Right now the Corps and EPA are limited to jurisdiction over “navigable” waters.

Rep. Oberstar is gutting the meaning of the word “Navigable” to allow Democrats on his Committee to vote for the Bill without getting hammered by you.  Your Congressman must hear from you that you are not falling for this trick. Penalize your Congressman for any vote for the Corps/EPA Land Grab Bill.

The House Transportation and Infrastructure Committee could bring the Corps, EPA, and Wetlands Bill to a vote anytime in November.  So this must be an all out push by you and your neighbors.   

The Corps, EPA and Wetlands Land Grab Bill is a huge threat to all private property in America.  It also threatens the use of Federal land.  Under the name “clean water” the Corps, EPA and Wetlands Land Grab Bill would give the Corps of Engineers, EPA and the Federal Government massive additional regulatory powers that supercede local and state government.

You must get your Congressman and both Senators to oppose this bill.  Don’t assume someone else will do it.  You must take the responsibility to call, fax, e-mail and visit your Congressman.

—–The Corps, EPA and Wetlands Land Grab Bill is the biggest land grab in 30 years.  Don’t wait.  Take action now. 

When you call, ask for the staff person who handles the Corps of Engineers (Corps) or Environmental Protection Agency (EPA).

Make it clear that a vote for the Clean Water Restoration Act (or any bill that does the same things but under a different name) will be held against the Congressman in the next election.

Make it clear that jurisdiction for the Corps and EPA must be limited to Navigable waters and not changed to “all waters of the United States.” 

Don’t make it like a threat.  Just make it clear that you and your neighbors will remember this vote for a long time.

P.S.  The Corps, EPA and Wetland Land Grab Bill is really a massive Federal land, water, wetlands and watershed power grab.  It must be stopped.  It will use “wetlands,” the Corps of Engineers and EPA to take control over every farm, ranch, and piece of private property with any water on it even if you only engage in “activities that might affect water.”  It will give the Corps of Engineers and EPA control over your land.  You’ll get tied up in a nightmare of red tape and bureaucracy.
